Since 2001, state governments have adopted 287(g) cooperative immigration enforcement agreements with the federal government that authorize their law enforcement personnel to assist in detaining violators of civil federal immigration law. Employing a theoretical framework drawn from theories of policy adoption, intergovernmental relations, and immigration research, we test which state‐level political, sociodemographic, geographic, and economic determinants influence states to enter into such a cooperative agreement. In addition to finding that the partisanship of a state's governor, a state's effort on public welfare, and an increase in a state's percentage of Hispanics are related to the adoption of a cooperative immigration enforcement policy, we found evidence of “steam valve federalism” working not at the state level as Spiro (1997) first theorized but at the local level. When a state's localities adopt immigration enforcement agreements with the federal government, the state itself is far less likely to adopt their own. Understanding the reasons states would adopt this type of policy sheds light on current trends in state immigration policy and their effect on future state/federal intergovernmental relations.  相似文献

The 1826 Maryland Jew Bill was the most protracted and heated fight over Jewish political rights in the United States. For eight years, in the legislature, in newspapers, and in elections, Marylanders debated whether Jews should be allowed to hold government office or positions of public trust, a struggle that garnered journalistic coverage from throughout the country. Historians have not explained why Maryland, a state with very few Jews in the early nineteenth century, was the site of the country's largest debate over their legal status. This study argues that Unitarianism, which did not claim many adherents in Maryland at the time of the Jew Bill but occupied an outsized role in the state's debates about religious rights and Christian orthodoxy, is a key part of the story of Jewish rights in Maryland; the state's unique experience with Unitarianism is one of the causes of the state's unique place in the story of Jewish rights in the United States.  相似文献

This article considers the early debates over state funding for in vitro fertilisation (IVF) treatment following the birth of Louise Brown in 1978 as a lens through which to re-evaluate attitudes towards womanhood, maternity and sexuality in 1980s Britain. The state's reluctance to devote resources to IVF reflected, in no small part, the financial imperatives on an overstretched National Health Service. Beyond financial considerations, the question of IVF funding sparked deeply gendered debates over the politics and social significance of motherhood and mothering, and the state's role in family planning and maternal and child welfare. In short, debates over IVF operated as a form of symbolic politics. Stakeholders – including patients’ advocates, women's associations, feminist activists and religious leaders – drew a clear link between the female body and the body politic and sought to articulate a policy towards both IVF treatment and infertile women more broadly that reflected their understanding of women's place within modern British society. Despite holding widely divergent views about gender, sexuality and motherhood, women's and religious groups found common ground in opposing state funding of IVF. This coalition facilitated the state's decision not to prioritise funding for IVF even as neighbouring countries, including Germany and France, embraced the procedure to help combat demographic decline.  相似文献

A prominent senior British specialist on the Russian economy reviews some consequences of the Russian state's dismemberment and partial re-nationalization of the Yukos oil company. The implications for state interventionism of Russia's engagement in international markets are assessed, and the effects of market feedbacks to Russian policymakers analyzed. Also considered is the question of whether Russian economic structure is changing in ways that could lessen the vulnerability of business to state action. Historically, Indigenous Australians have been marginalised, both economically and politically, in mineral development processes in Australia. The Australian state structures the interaction between Indigenous people and mining companies through general legislation and policies, and is therefore a key determinant of the mineral negotiating environment. This paper examines the state's role in the negotiations for the Century Mine in the Gulf of Carpentaria, and argues that recent neo-Marxist theories offer the most cogent theoretical explanation of the state's behaviour. It contends that, despite a noted tendency to consign Marxist theorising to the history books, analysis of the behaviour of the state in the Century negotiations provides critical evidence of the continued relevance of neo-Marxist theories of the state.  相似文献

Over 1000 long-term local residents responded to a survey of Oklahoma's vernacular regions. They indicated that their local regions had changed names over time. A majority of respondents in more than 40 of Oklahoma's 77 counties recall that their localities were called "Indian Territory" or some more specific variation on that theme in the past. Because "Indian Territory" was a term produced by the Federal government, this suggests that the central government exercised substantial control over the toponymy of that time. Other institutions currently dominate the state's toponymic process. Respondents in almost one-half of Oklahoma's counties refer to their local regions with names generated by the state's Department of Tourism and Recreation. Residents in a small number of multi-county regions employ terms derived from their local cultural and economic histories, and others inagroup of single-county regions use extremely localized terms. As a result, it appears that Oklahoma's state bureaucracy has become the dominant toponymic force among local residents, displacing the once-powerful Federal government. Interestingly, Oklahomans now recognize more locally-defined regions than they did in the past as well.  相似文献

ABSTRACT This paper investigates the determinants of productivity growth in the manufacturing sector of states over the period 1959-1973. Special emphasis is placed on isolating the effects of a state's urbanization characteristics on productivity growth. Urbanization characteristics considered include the spatial arrangement of cities along with the standard measures of urbanization. The results indicate that while both scale economies and technical change are related to urbanization characteristics the effects tend to be offsetting; no relationship is found between urbanization and overall productivity growth as measured by total factor productivity growth.  相似文献

The paper defines the state's apparatus as a site of power and contestation. This view enables contingency in the realm of government to be taken seriously. Accordingly, the paper takes a critical view of the idea of neoliberalism as a general global process. The paper reviews Paul du Gay's history of the state's apparatus, including his nostalgia for bureaucracy and his disdain for entrepreneurship. The paper contrasts du Gay's stylised take with a study of shifts in institutional structures and behaviours in Australia's state apparatus since the mid 1970s leading to the present period of Howard neoliberalism. The paper positions these shifts in the context of Coombs‐led institutional reform in Australia; it examines the potential for institutional resistances and responses; and draws implications for how we view institutions as having agency in the political processes of state apparatus reform.  相似文献

Abstract: A martial state's neoliberal policies opened the nation's frontiers to new forms of globalization. This article investigates the political process that undergirded the military and global capital's sequestration of common land in Karachi and the concomitant contestation by a key civil society organization. Using Foucault's conception of sovereignty and government as an assemblage of authority and strategies of rationalization, this paper analyses the role of state and non‐state actors and changing power configurations in a conflict that surrounded the enclosure of a common and its transformation into a securitized zone of consumption in Karachi's Civil Lines. The conflict highlights the nature of the politics of space and citizenship in Pakistan's primary metropolis.  相似文献

This study explores the process by which the treatment of infertility, which has been in the hands of the private sector, has been taken over by the state as a matter of public health. It argues that this shift stems from the pro-natalist policies of the state to help increase the population. Infertility treatment, using assisted reproductive technologies and its legitimization by the Islamic jurists, is used as a lens through which to examine the state's body politic. The frequent reversals of policies, since the late nineteenth century to the present, are shown to be directly linked with the nation-building goals of the state, expecting the citizens to readjust their reproductive behavior to meet the state’s policies.  相似文献

This paper explores a dual absence — the absence of the state within contemporary geographical analyses of nature; and the absence of nature within contemporary explorations of state power. We argue that the modern state continues to play a crucial role in framing social interactions with nature, while nature is still vital to states within their realization of different forms of material and ideological power. In order to reconnect analyses of the state and nature, this paper combines work on the production of nature and state strategy with Lefebvre's recently translated writings on state space and territory. By focusing on the production of territory (or state space), we explore the interaction of the state and nature in the context of the political management of social and ecological space. We unravel the spatial entanglements of the state and nature through an analysis of the British state's territorial strategies within the West Midlands region. By considering three key historical periods within the history of the West Midlands we reveal how the emergence of the regional space called the West Midlands is a product of the ongoing spatial dialectics of state and nature therein.  相似文献

This article pays special attention to the large number of references to political theology by Hans Kelsen and Carl Schmitt, particularly in the interwar period, and seeks to interpret these references in a new way. While Schmitt's analogies between God and state are to be expected considering his strong Catholic roots, such comparisons are much more surprising for a positivist like Hans Kelsen, who always tried to relieve state and law from transcendental elements. The article concludes that, far from being marginal in the doctrinal dispute between Schmitt and Kelsen, references to political theology express and summarize their major controversy about the relation between state and law, as well as about the sources of the state's unity. The heart of the disputatio between the two jurists concerned the ability of the political power to emancipate itself from the juridical order. The ‘legal miracle’—in this context meaning the occasional autonomization of the state from law—was for Schmitt the manifestation of sovereign power. However, for Kelsen it represented the negation of the state's essence, whose actions must be determined only by the legal order.  相似文献

There has been much discussion recently on the ‘great Indian land grab’, that is, the acquisition of productive land by the government, and the handing over of this land to large‐scale industry. What do these ongoing land transfers tell us about the nature of the state? This article builds a picture of the state in a liberalizing landscape based on empirical evidence. It outlines the role of the state in Kutch during a transfer of 30 km2 of forest and coastal land to a cement manufacturing and exporting operation ‘Karkhana Ltd.’ (pseudonym). Karkhana's experience does not evince a state in withdrawal. Nor do we witness a regulatory state that watches a changing economy from the legal and coercive sidelines. Instead, the case study is able to reinforce heterodox perspectives that place the state at the centre of India's new economy as a close ally of big capital. Taking these views forward, the author suggests that the state's role in this alliance is that of a normative legitimator of liberalization, a buffer in the contentious politics of land, and an institutional promoter of and manoeuvrer through the new land regime. A multifaceted state is indispensable to India's liberalizing landscape.  相似文献

The southern question has been posed at the key moments in the history of the Italian state. Today we face a moment of comparable importance which urges that the southern question be re‐thought. It is not an unchanging question, yet it concerns issues fundamental to the state and has been treated by the country's greatest intellectuals as a national issue. The meridionalisti have been Italy's critical conscience yet, at the same time, stereotypes of a uniformly backward South have taken hold. The post‐war intervention in the Mezzogiorno should not be seen through such stereotypes as a wholly negative experience. Its successes and failures fit into an Italian pattern of state‐led modernization and it cannot be understood in isolation from the Italian state's weaknesses. Today, a new pact between the weakest and strongest sectors is essential. The South's economic and political leadership will be a central object of study if intellectuals are to help inform new policy.  相似文献

Numerous commentators argue that the nation-state is an endangered species. External forces of globalization and internal forces of social differentiation, many suggest, are significantly weakening the state's capacity to regulate its subject population within its jurisdictionally-defined space. Such an argument is often made in the specific case of crime control. The spread of international communications networks and the growth of international policing suggest that single-state crime control efforts will increasingly be insufficient, the growth of private security and community-oriented crime reduction efforts suggest that the state is surrendering crime control to other domestic agencies. This paper examines the specific case of crime control in the United States to argue that the putative weakening of the state is not in fact occurring. When examined more closely, suggested evidence of decreased state power vis-a-vis crime turns out, if anything, to demonstrate the opposite. The analysis demonstrates that, in the American case especially, the state remains startlingly relevant when it comes to efforts to combat crime and maintain order. Because police agencies are bureaucratic institutions that must demonstrate their relevance to ensure their continued health, and because the state's broader legitimacy is linked to the provision of security, the public crime control apparatus promises to remain robust for the indefinite future.  相似文献

ABSTRACT. The study of nationalism in Egypt has often focused on Arab nationalism and its relevance to the post‐colonial state building process. The current article shifts the focus to the Egyptian state's strategic use of nationalism as a mechanism for survival and for shoring up its failing legitimacy. In particular, the case of the human rights debate is chosen to show the regime's most recent attempt to ‘nationalise’ a rising movement which promotes universalism and poses a threat to the notion of the nation's homogeneity. By misrepresenting human rights organisations as mouthpieces of Western imperialist powers, the regime has managed to create an image of these organisations as posing a threat to Egypt's national security and undermining its international ‘reputation’. More recently, however, the state has refined its discourse on human rights by promoting an image whereby it is the ‘official agent’ of a more nationalistically defined human rights movement.  相似文献

This article examines the social and political significance of female suicide in Qing Dynasty China and its implications for women's agency, feminine subjectivity and the state's interpretation of violence. Tracing the development of state and elite interpretations of the propriety of women's suicides, it situates the discourse on female suicide in the context of state efforts to control the definition and enactment of moralised violence and pervasive rhetoric about women's incapacity for moral agency. Demonstrating the problematic ethical and judicial status of suicides committed in the wake of a violation of chastity, in particular, it argues that such suicides represented a distinctively female definition of moral order and the role of violence within it.  相似文献

Recent anthropology of the state is influenced by sociology's cultural turn—taking up “the state idea” as situated meaning. The works reviewed here pursue the state's idea of itself—in two cases through state projects of extreme social and cultural engineering, in two as a comparative problem. Notwithstanding differences of purpose and approach, the authors evince tacit points of convergence around the state as a form of modernism, as a function of elite interests, and as a localized process of depoliticization, associating dissent with cultural authenticity. The essay relates these points to western state nationalism and current ethnographies of political subjectivity.  相似文献

In 2014, the Peruvian federal government declared the low‐income neighbourhood of Pueblo Libre de Belén in the Amazonian city of Iquitos to be in a state of emergency. A federal decree stated that ‘constant inundation’ from the Itaya River had put residents and their homes in jeopardy. Following this declaration, the federal government proposed to resettle residents in a planned community, 13 km outside the city. Drawing from interviews with 77 households in the neighbourhood, this article examines residents' responses to the relocation plan as well as their deep scepticism over the motivations driving it. Considering the state's plans for redeveloping the area as a tourist zone, this case study illustrates how concerns about the future impacts of environmental change – and flooding specifically – can be exploited by state actors for economic and political gain while further disenfranchising vulnerable urban populations.  相似文献

The nation is a relatively abstract imagined community that is visualised through a variety of symbols as well as communicative and performative practices. In this paper, we explore how the national territory, one of the foundations of the nation‐state, is performed on national‐day celebrations and brings the nation into being. Drawing on ethnographic research on national days in Burkina Faso, Côte d'Ivoire and Ghana, we show how the state's internal administrative divisions and ethnic differences are at once made explicit but also subordinated to the nation. Moreover, we show how in such celebrations, potentially disruptive or competing affiliations such as ethnicity and regional loyalties are re‐imagined. Both the rotation of the central celebration and its replication all over the national territory carry the nation into the regions and integrate the regions into the nation‐state. The ‘co‐memoration’ turns participants and spectators from locals into national compatriots and thus not only performs nationality but also performs the relationship among nation, state and citizen, set within a particular territory.  相似文献
