This paper analyses, from the perspective of cultural policy considerations, the legal regime established by the recent Polish law on the immunity from seizure of cultural property on loan (2015). It deals with current trends of international museum exchange and explains the benefits and risks involved in cross-border loans of cultural material. This analysis is carried out by focusing on the actual practice and experiences of Polish museums, national and international regulations in force, and human rights considerations. The authors attempt to situate the Polish model for the protection of foreign cultural property on loan within the broader comparative context of the domestic legislation on museum exchange adopted in selected national jurisdictions. The article also offers a more general cultural policy discussion in the context of international museum exchanges of cultural material. Laws and policies facilitating such exchanges are weighed against other rights and interests encompassed in the protection of cultural heritage and the realisation of all human rights, including cultural rights.  相似文献

第二次世界大战前后,由于国际格局的变迁,英国工党的外交政策发生了很大变化。理想主义是战前工党外交政策的主调,在国际问题的处理上它信奉集体安全政策,主张发挥国际联盟的作用,反对重整军备。经过第二次世界大战,工党逐渐接受了丘吉尔战时政府的现实主义外交原则,战后初期工党执政后,在外交政策方面摒弃了过去的理想主义,把现实的国家利益作为外交政策的重点。工党政府推动美国参加欧洲防务,借助美国的力量建立起欧洲均势,满足了国家安全的现实需要。在非殖民化问题上,工党政府同样从现实主义出发,撤出了印度和巴勒斯坦。从战前的理想主义到战后的现实主义,工党外交理念的变化在某种程度上反映了这一时期英国外交的演变过程。  相似文献

Pessimistic accounts of women's lives in post-communist Poland view women as powerless and passive victims of the transformation process. In contrast, this article argues that while political change and the restructuring of the economy have closed down some spaces of articulation and organisation, others have opened up. The article focuses on the way in which women in their spheres of work are shaping and actively resisting change through new organisations and individual and collective actions, which are in some ways a break with the past, but in other ways build on previous forms of activity. The work draws on qualitative research conducted over the last decade across Poland. This has coupled extensive interviews with women workers, national and regional trade union leaders, activists and feminists in a number of major Polish cities with reviews of Polish media and policy. We examine the economic and ideological context in which these new articulations are taking place, against the background of Poland's post-war communism and the rise of opposition movements. We look at the neoliberal restructuring of the economy and the implications for women within the labour market and in their domestic lives. In particular, we examine initiatives from below in workplace organisation, by focusing on new unions and new actions in the public sector, and the beginnings of organisation in the new areas of the economy such as supermarkets. Finally, we look at how women are articulating their interests beyond formal workplaces. We conclude that we should be optimistic about these new spaces of activism. While some are well established, others are embryonic but provide a strong foundation on which women can increase their participation in spaces that promote their varied interests.  相似文献

This article investigates how concepts from the field of public policy, in particular the Advocacy Coalition Framework (ACF) initially introduced by Sabatier and Jenkins‐Smith, can be applied to the study of foreign policy analysis. Using a most similar comparative case studies design, we examine Switzerland's foreign policy toward South Africa under apartheid for the period from 1968 to 1994 and compare it with the Swiss position toward Iraq after the Iraqi invasion of Kuwait in 1990, when the Swiss government imposed—for the first time—comprehensive economic sanctions against another state. The application of the ACF shows that a dominant advocacy coalition in Swiss foreign policy toward South Africa prevented a major policy change in Swiss–South African relations despite external pressure from the international and national political levels. Actually, quite the opposite could be observed: Swiss foreign policy increased its persistence in not taking economic sanctions against the racist regime in South Africa during the 1980s and early 1990s. The ACF, with its analytical focus on policy subsystems and the role of external shocks as potential triggers for change, provided a useful framework for analyzing the factors for policy change and stasis in Swiss foreign relations toward the selected two countries.  相似文献

This article addresses the role of democracy in Australia’s foreign policy formation. It argues that public debate and deliberation on foreign policy is a normative good. When there is a lack of debate on a government decision, a democratic deficit occurs. Such a deficit is evident in the way Australia goes to war; however, the examples of Canada and the UK show that reforming parliamentary practice is possible. In the context of the ‘war on terror’, this article compares Australia, Canada, and the UK from 2001 to 2015 with regards to ‘war powers’. Drawing from debates recorded in Hansard, it finds that while Canada and the UK took steps to ‘parliamentarise’ their foreign policy formation, the war-powers prerogative of the Australian government remained absolute. It concludes that increasing the role of parliament may go a long way towards democratising the decision of when Australia goes to war. This has practical as well as normative benefits, since it may prevent governments from entering wars that are unsupported by the public. At minimum, it will compel governments to engage more thoroughly in public debate about their proposed policies, and justify their decisions to the nation.  相似文献

Though always more exposed than many other countries to the vicissitudes of international competition, Australia seems to have become increasingly vulnerable to the pressures accompanying global restructuring. This much is evident in the pattern of foreign debt, the balance of payments and trade, and fluctuations in our exchange rate. Media paranoia over the day-to-day pegormance of macro-indicators obscures, however, the pressures global restructuring has brought against the integrity and efficacy of our major institutions Not only have there been serious questions raised about the usefulness of the centralised arbitration system in the context of global restructuring, the Australian labour movement itself faces an uncertain future. Notwithstanding the claimed virtues of an enterprise-based labour relations system, there are good reasons to suppose that a decentralised system would have its own problems in accommodating rapid economic change. In this respect, the search for an American-style decentralised institutional regime may be ill-advised; more useful may be an enhanced capacity to adjust within the current framework of Australian labour relations.  相似文献

Abstract

Poland's ‘silent revolution’ which led to the disintegration of the Communist regime in 1989 was inevitably reflected in the financial situation of archaeological research. Some well-established institutions which lost their secure government funding were disrupted or even destroyed.

Cuts in the numbers of research staff (by around 30%), the change of research priorities from purely problem-oriented studies towards rescue excavations and the introduction of the market mechanism (in the system of grants and short-term contracts) began a process of painful reorientation and restructuring.

The challenge posed by private enterprise, by a gigantic programme of highways construction and by the emergence of wealthy sponsors brought about changes in the mentality of Polish archaeologists, changes which took place under the influence of growing surveillance by society at large and by the communications media.

Notions of social responsibility, ethics, effectiveness and financial transparency should define this ‘new’ reality which has been taking shape under the pressure of daily problems. However, far from all working archaeologists are able to understand this challenge.  相似文献

1977年的《巴拿马运河新条约》,是卡特政府在外交政策上的标志性成果之一。它的签署和通过,是卡特政府在复杂的国内外局势下实行双重政治博弈的结果。面对具有强烈民族主义倾向的巴拿马人民,卡特政府从国家长远利益出发,顺势而为,适度妥协;面对政府内部行政部门间的意见不一和顽固保守的国会势力,卡特政府在守住政策底线的前提下,通过巧妙施压和正面劝导,积极争取中间势力的理解和支持。这种内外博弈过程突出反映了在切实维护国家利益的重大外交决策问题上,美国现行宪政体制的功能和效用具有典型的两面性一方面,对内尽可能争取相关各方在重大外交政策上理解和支持的最大公约数,以有效增加美国对外政治斗争中获胜的筹码;另一方面,决策上的混乱拖沓增加了内耗,使得某些符合整体长远利益的重大外交决策不得不迁就于注重眼前、局部利益的国会系列修正案,导致重大外交政策的实施初衷与实际后果之间出现明显偏差。  相似文献

This article examines the threat to European liberal democratic values posed by the current asylum crisis. Drawing on a historical analysis of European asylum policies, it examines the origins of the post-Second World War refugee regime and the sources of the current challenge to its liberal universalist premises. The argument discerns two dominant forms of critique of the liberal model in twentieth-century debates on refugee policy: welfare protectionist nationalism, and ethno-centric or racist nationalism. Both of these justifications for restricting asylum have resurfaced in contemporary debates, used by—respectively—centre-left and far right parties. Having considered why these arguments have resurfaced, the article suggests three scenarios for future European responses to the asylum crisis and their implications for liberal universalist values. It argues that the liberal approach can only be sustained through more effective EU burden-sharing and the reorientation of EU external policies to incorporate refugee and migration issues.  相似文献

The article argues that a central aspect of Israeli-Polish relations before 1967 was their tripartite nature, involving the two states and Polish Jewry. The main goal of Israeli diplomacy in Poland, to which it subordinated a variety of interests, even those that were central to Israel's foreign policy, was the immigration to Israel of Polish Jewry. The three elements of the triangular relations (Israel, Poland, and Polish Jewry) influenced one another through their policy and behavior, monitored each other, interpreted each other's actions, and reacted accordingly. The aliyah from Poland engendered a new dynamic in the relations. Israel was able to implement its nation-building policy through the immigration of a desired element, and the Polish authorities, by allowing emigration of an unassimilable ethnonational minority, homogenized the nationalizing Polish state. After the massive emigration of the Jews, another element connecting and reshaping the three sides of the triangle emerged: the competition to represent the memory of Polish Jewry, conceived, too, as an instrument in the nation-building process of both states.  相似文献

Surprisingly little has been written about the century-long relationship between Saudi Arabia and Europe, beyond snapshots of certain periods or certain aspects. Similarly, very few attempts have been made to seek long-term patterns in Saudi foreign policy. This article aims to fill this double gap. It shows that these patterns link even the earliest days with the present day, that they are inter-twined with the very building, consolidation and survival of the Saudi state and Al-Saud rule, and that they have implications for the future of Saudi-European relations.
The article also aims to draw lessons from the Saudi case for the understanding of the foreign policy of developing/small states more generally. The Saudi-European relationship provides an illustration of the extent to which small/'dependent' actors in the international system can acquire a measure of autonomy. The room for manoeuvre which adept local leaders can turn into relative autonomy at the domestic, regional and international levels emerges from the combination of particular domestic circumstances (the availability of material and political resources) with external ones (including limitations on, and competition between, great powers; and the global scattering of great-power interests, as opposed to local actors' regional concentration). Such relative autonomy for the state at all three levels has allowed the Al-Saud to pursue the survival imperative and other interests through the long-term foreign policy patterns of managed multi-dependence and pragmatism.  相似文献

Abstract

For Greece, to be part of the European Communities/European Union, it has always been a constant challenge to the country's international position. Sixteen years of EC membership have had a remarkable political, diplomatic, socio-economic and cultural effect on the country's internal domain. Indeed, EC membership has contributed to the consolidation of democratic internal processes, it has influenced the administrative capacity of the state, it has affected the external political orientation of the country's foreign policy objectives, it has benefited the economy from substantial financial community transfers and it has brought the Greek culture closer to the other western European cultures. Seen from a more critical perspective, BC membership has also produced severe shock effects, as the Greek economy has been increasingly exposed to European trade and the subsequent single market and it keeps on breeding social tensions in the process of economic and monetary integration.  相似文献

This article focuses on Polish economic policy during the détente era to explore Poland's growing connection with the West as well as assesses the importance of domestic and external factors in influencing the choices of the Polish ruling elite. The two party first secretaries of the period, Gomu?ka and Gierek, were often opposed to each other, and the merit of Poland's opening up to the West is usually attributed to the second. By analysing Gomu?ka's and Gierek's leadership respectively, the author appraises the different ideas that characterised their economic policy, as well as the domestic and external constraints they faced, in order to assess the limits and flaws of their attempts at integrating the country into the world economy. This article offers a double reappraisal of the Polish leaderships' policies. First, it demonstrates that the economic opening up to the West had already started in the 1960s under Gomu?ka, despite limited East–West contacts at the time, and was driven by a proactive Polish government. Second, it downsizes the success of Gierek's economic policy and shows that it was mostly merely reactive to domestic pressure and foreign trends; its shortsightedness got Poland into the trap of spiralling indebtedness and irremediable social discontent with the regime.  相似文献

Western analysis perceives Russian approaches to issues of humanitarian intervention and the Responsibility to Protect (R2P) as running counter to western‐inspired international norms. This debate has surfaced with some vigour over Russia's policy in the Syria conflict where, in order to protect its strategic interests in Syria, an obstructionist Moscow has been accused of ignoring humanitarian considerations and allowing time for the Assad regime to crush the opposition by vetoing a resolution threatening to impose sanctions. While Russian approaches are undoubtedly explained by a desire to maximize its growing political influence and trade advantages to serve its legitimate foreign policy interests, and while Moscow's attitudes to intervention and R2P exhibit important differences from those of the major western liberal democracies, its arguments are in fact framed within a largely rational argument rooted in ‘traditional’ state‐centred international law. This article first highlights key arguments in the scholarly literature on intervention and R2P before going on to examine the evolution of Russian views on these issues. The analysis then focuses on the extent to which Moscow's arguments impact on international legal debates on the Libya and Syria conflicts. The article then seeks to explore how Russian approaches to intervention/R2P reflect fundamental trends in its foreign policy thinking and its quest for legitimacy in a negotiated international order. Finally, it attempts to raise some important questions regarding Russia's role in the future direction of the intervention/R2P debates.  相似文献

Abstract

This article examines Indian humanitarian help for Republican victims during the Spanish Civil War. It focuses in particular on aid initiatives by the Indian national movement, which were embedded in the larger quest for independence from British colonial rule. By creating their own humanitarian programme in favour of Republican Spain, Indian nationalists dissociated themselves from Britain’s foreign policy and tried to orchestrate a politics of moral superiority for themselves. The article also explores Indian participation in transnational networks of Left solidarity. Established to generate political and humanitarian support for Republican Spain, Indian actors concurrently utilized these networks to enhance their status in the international community and to advance their own end of an independent state.  相似文献

A U.S.-based geographer discusses the effects of foreign direct investment (FDI) in the Polish passenger car industry. The paper illustrates the magnitude of enterprise restructuring and changes in a significant economic sector. Using the case study approach, the author focuses on three of the largest foreign-owned passenger car makers in Poland: Fiat Auto Poland, Daewoo-FSO, and Opel Polska. He then considers FDI in the rest of the Polish automobile industry, noting inter alia Poland's proximity to West European markets and the country's low-cost labor. The case studies, based in part on recent interviews, discuss investment policies, enterprise restructuring, production trends, and effects of FDI in the supplier bases of car makers. The article discusses the question of why and how the normalization between the United Arab Emirates (UAE) and Israel took place and managed to evolve into a peace agreement. It offers an additional explanation to the neorealists' scholarly and commonly accepted argument: that it was only the behavior of the revisionist state of Iran that was the motive for signing the peace agreement between the two states. Furthermore, the article argues that the normalization of relations began in 2004 and could have materialized owing to the UAE's neoliberal foreign policy of focusing on soft power cooperation. It suggests the UAE's internal interests of status, stability, and empowerment, which were incorporated in the Vision 2021 plan, were translated into a foreign policy of international cooperation rather than one of military involvement and alliances. The UAE's long-term strategy reveals a dual neorealist and neoliberal foreign policy with a tendency toward the latter. The neoliberal foreign policy of soft power cooperation attracted the UAE to Israel and, through these shared interests, built trust and eventually led to normalization between the two states. The study covers three periods of the UAE's foreign policy strategy during the development of the normalization process. It begins with the tension between the neoliberal and neorealist strategies from 2004 to 2009, then looks at the increase in tensions between 2010 and 2018, and ends with the focus on the neoliberal foreign policy strategy in 2019–2020.  相似文献

Abstract: In the UK there has been a proliferation of agencies at differing regulatory scales as part of the rescaling and restructuring of the state by New Labour, following the neoliberal policies of previous Conservative governments. This raises questions concerning the extent to which New Labour's urban state restructuring is embedded within neoliberalism, and the local tensions and contradictions arising from emergent New Labour urban state restructuring. This paper examines these questions through the analysis of key policy features of New Labour, and the in‐depth exploration of two programmes that are reshaping urban governance arrangements, namely Local Strategic Partnerships (LSPs) and New Deal for Communities (NDC) programmes. We conclude that New Labour's restructuring is best understood in terms of the extended reproduction (roll‐out) of neoliberalism. While these “new institutional fixes” are only weakly established and exhibit internal contradictions and tensions, these have not led to a broader contestation of neoliberalism.  相似文献
