董必武对民族法制工作的重要贡献

我国地方民族立法体系述评

新时期我国法制建设的历史进程与基本经验

以1982年宪法的公布实施和1997年依法治国基本方略的确立为标志,新时期我国法制建设的历史进程可分为三个阶段:从1978年到1982年为恢复阶段;从1982年到1997年为全面发展阶段;1997年以来为全新发展阶段。新时期我国法制建设的基本经验主要有:必须正确处理党的领导与法制建设的关系;必须正确处理法制建设与经济建设的关系;必须把民主建设与法制建设结合起来;必须把立足中国国情与借鉴外国经验结合起来;必须不断完善法律监督体系。

本文论述了蒙古民族在历史上的作用及其教育制度的演变,得出了"民族发展是民族教育的根本条件,民族教育反过来促进民族的发展,发展民族教育必须依靠民族本身的努力和正确的教育政策"的结论.     

Italy's political system since 1989

This essay follows the development of the Italian political system over the last twenty-five years, starting from the collapse of the principal political parties that had previously dominated the history of the Republic. In institutional terms, it seems legitimate to describe this as a transition, since the outcomes of initiatives to reform the electoral system, to abolish the previous system of ‘perfect bicameralism’, and reshape relations between the State and the regions are still unknown. But I argue that many fundamental changes in the relationship between the country and its political system were already evident in the 1980s.     

Galen and the ventricular system

This paper examines the anatomy and physiology, together with the pathophysiology, of the ventricular system of the brain, as it was understood by arguably its greatest exponent in Western Antiquity, Galen. According to him, the purpose of the ventricles was to elaborate, store and distribute psychic pneuma, the motive force of Galenic neurology, throughout the nervous system. However, impressive as the delineation of the ventricular system is, the details of this distribution are not forthcoming from Galen. Finally, I discuss the ventricles as the site of intellect, a notion only tentatively advanced by Galen, but cast into dogma by his successors. For all the mistakes Galen made in anatomy and physiology, the study of the ventricular system reveals a mind not dissimilar to our own.     

De-democratising the Irish planning system

This paper examines the practices deployed to de-democratise elements of the Irish planning system. It does so through scrutinizing the processes by which a new streamlined planning procedure for large scale residential developments was institutionalized. The paper investigates how a development lobby group successfully prompted the institutionalization of this streamlined procedure by momentarily capturing the policy formulation agenda surrounding a housing crisis. It demonstrates how this was achieved by defining problems regarding the democratic character of the planning system and accruing agency through solution specification and resonance with the ideologies and rationalities of pertinent political and senior civil servant decision makers. The paper undertakes this analysis by situating a discourse analytical approach within the Multiple Streams Framework. In doing so, the paper provides an original contribution to academic scholarship through novelty of theoretical application on a disquieting aspect of neoliberalism in a planning context that as yet has received limited attention.

Legislative accountability in a mixed-member system

Accountability of representatives to electors is a key indicator of democratic health. In mixed-member systems, the coexistence of two kinds of representation provides the opportunity to test competing claims with minimal confounding factors. There is debate about the relative accountability of constituency and list MPs, and in particular, concerning dual candidacy, where individuals can stand for both constituency and list seats. Analysing New Zealand elections since 1999, with comparisons back to the previous single-member plurality system, this article examines the effects of dual candidacy, legislative turnover and the cases where constituency or electorate MPs have lost their seats, but remained in Parliament as list members.

代表对选民负责乃民主是否健康的一个关键指标。在混合成员制下,两类代表的共存为比较单纯地检验其竞争的主张提供了机会。不过,选区及名单议员的相对责任,尤其在一个个体可以既代表选区又代表名单席位的情况下的责任,对此是有争议的。本文分析了新西兰1999年以来的选举,并与之前的单一成员多数选举制做了对比,还考察了双重候选人制的效果、议员的流动、以及选区或议员落选但依然是国会名单成员的情况。
