英国废除《谷物法》刍议

皮尔政府废除《谷物法》体现了英国现代转型的时代潮流,此时《谷物法》失去了社会多数群体的支持,能否废除的关键取决于持不同立场的议员在议会内的博弈。谷物法的产生与废除都是某种特定的历史范畴,无论在废除谷物法问题上持赞成或反对立场的议员,他们代表的只是城镇或是农村的部分群体的利益,却同时伤害了农村的利益。《谷物法》不能简单地看成为一个阶级立法,赞同《谷物法》的不仅有土地贵族,也有农场主和耕地农。

During follow-up work, scholar Ante Juri?-Aramba?i? conducted interviews concerning the singer's biography. All material is here reported, translated, and interpreted for the purpose of thickening the corpus of Parry and Lord archival materials and for improving our reconstruction, based on the available evidence, of the traditions flourishing in the region during the first half of the twentieth century.     

William of Malmesbury and fortuna

The great Benedictine historian William of Malmesbury has divided scholarly interpretation over recent decades. For some, William was a precocious scholarly talent who steered around or subverted the constraining absurdities of the providential orthodoxy. For others, his explicit expressions of faith in God’s providence, despite its often vexatious reverses, betray a sincere piety and reverence for the hidden justice of divine cosmic rationality. These conclusions have relied on flawed assessments of William’s use of the term fortuna, fortune. They adhere to a broader status quo that imagines all medieval thinkers took for granted that fortune’s reverses were inscrutable and inevitable. On the contrary, this article argues that William was concerned with determining the precise causes of fortune, so that he might prescribe ethical advice to prevent its reverses. This has consequences for understanding the ends of twelfth-century historical writing and the development of thought pertaining to individual and collective punishments.     

Laws,People and Land Use: A Sociological Perspective on the Relation Between Laws and Land Use

Public policy is often implemented through formal laws. In contrast to the typically optimistic ex-ante analyses of the impact of a set of laws, in retrospect it may be hard to determine what the laws concretely produced. Particularly complicated to measure are the unintended and indirect effects on actors or values that were not the prime focus of the law. Despite the literature on these matters in other fields of research, among planners the theory of law implementation receives relatively little attention. This attitude may stem from the means-ends rationality that has been common to planning for so many years. This paper makes a plea for focusing on the interaction between people and laws so as to understand the outcomes. We do this by drawing insights from sociological perspectives on laws.
