在13世纪中期,因为地方司法治理不力,英国臣民向王室施加了巨大的政治压力。与此同时,为了扩大管辖范围,罗马教廷和巴黎高等法院也向英国王室发起有力的主权挑战。英国国王爱德华一世被迫开展司法改革,以应对这些压力和挑战,进而加强其统治权威。其中的一项重要举措就是允许臣民向议会呈递请愿。在当时,议会请愿的主要内容是寻求司法公正和祈求王室恩惠。它的推行,一方面加强了王权,另一方面维护了民权,由此受到普遍的欢迎和支持。正是在爱德华一世统治时期,议会请愿获得了初步发展,成为议会制度的重要组成部分。这标志着英国议会请愿制的成形。最后要指出的是:议会请愿的起源,深受英国君臣之间实力对比的影响。  相似文献

This article considers the opening up of parliamentary proceedings to greater public scrutiny in the two decades after the 1832 Reform Act. It examines developments in the publication of parliamentary debates, considering why proposals for an official parliamentary record were rejected in the 1830s. It also discusses two less well‐studied but equally vital means of publicising parliamentary activity: the publication of official division lists and the sale to the public of parliamentary papers. It argues that the 1830s was a critical decade of change, influenced by shifting perceptions of the relationship between the reformed house of commons and those it sought to represent. This was driven, in particular, by liberal notions of the importance of parliamentary accountability to public opinion: MPs were increasingly aware of the need to keep constituents informed of their parliamentary activities, whether in the chamber, committee room or division lobby. This article also highlights the extent to which the Commons' approach to publicising its activities was constrained not only by the fact that it remained a breach of parliamentary privilege to publish reports of debates, but also by the physical space that the Commons occupied. The destruction of much of the old Palace of Westminster by fire in 1834 provided an important opportunity to remodel existing arrangements, notably with the addition of a second division lobby and the construction of a reporters' gallery.  相似文献

In 1964, the Premier of Victoria, Australia, Henry Bolte, announced that, in order to protect irrigation interests in the north of the state, he would prevent Melbourne from developing new water resources from the north of Victoria's Great Divide. Neither the water resource needs of Melbourne, the need for irrigation development nor the changing economic structure of the state provides a satisfactory explanation for this decision. Instead, Bolte's policy appears simply to have provided a means of improving the parliamentary position of the Victorian Liberal government. Bolte's principle has never been formally revoked and continues to influence water resource planning in the state. In order to make the most appropriate use of Victoria's limited natural resources, it is imperative that ‘Bolte's divide’ should not continue to influence future resource development and allocation.  相似文献

This article presents three distinct interpretations of how parliamentary war powers affect British foreign policy more generally, based on a detailed analysis of the debate preceding the vote in parliament in August 2013 on whether Britain should intervene in the Syrian civil war. The first interpretation treats parliament as a site for domestic role contestation. From this perspective, parliamentary war powers matter because they raise the significance of MPs' doubts about Britain's proper global ‘role’. The second interpretation treats parliament as a forum for policy debate. There is nothing new about MPs discussing international initiatives. But now they do more than debate, they decide, at least where military action is involved. From this perspective, parliamentary war powers matter because they make British foreign policy more cautious and less consistent, even if they also make it more transparent and (potentially) more democratic in turn. The final interpretation treats parliament as an arena for political competition. From this perspective, parliamentary involvement exposes major foreign policy decisions to the vagaries of partisan politicking, a potent development in an era of weak or coalition governments, and a recipe for unpredictability. Together these developments made parliament's war powers highly significant, not just where military action is concerned, but for British foreign policy overall.  相似文献

There have been legions of individual studies of the history of the English/British/United Kingdom parliament, which is not surprising, since its history is widely acknowledged to be so closely bound up with the history of the nation state itself. But there have been remarkably few attempts to put the story together, to try to consider the long‐term development of parliament as an institution. What would such a story look like? This essay discusses some of the critiques of the whiggish narrative of constitutional and parliamentary development to recognise a common theme in whiggism's tendency to anthropomorphise parliament, to describe it as a single organism with agency and purpose. To forgo that temptation, however, makes it difficult to provide a satisfying narrative of parliament over time. The essay tries to imagine how one might construct a history of parliament as an institution which no longer sees it as an actor in its own story, but, instead, a complex collection of ideas, processes, customs, and conventions, which competing forces struggle to organise in order to achieve their goals, and which is also an arena and forum for that competition.  相似文献

This article seeks to highlight the important part played by Bishop William Laud in the counsels of Charles I in the 1620s, and, in particular, his involvement in the parliamentary sessions of 1628 and 1629. Having demonstrated his usefulness as a parliamentary spokesman for the crown in the parliaments of 1625 and 1626, and having been promoted to the privy council, the parliament of 1628–9 witnessed the height of Laud's parliamentary engagement. His key role as a writer of memoranda and speeches both for the duke of Buckingham and for Charles himself demonstrate the weight accorded to his political views. These views, reflected in his writings, sermons and his contributions to parliamentary debate, embody a dislike of parliamentary bargaining, a firm commitment to uphold the royal prerogative, particularly in matters of taxation, and a determination to resist encroachments upon it by the common lawyers, whether by the confirmation of Magna Carta or in the form of the Petition of Right. The expression of these views in such an emphatic fashion would come back to bite him, in the parliamentary attacks on him in 1629, but above all at his trial in 1644. Nevertheless, his articulation of them suggests that Laud himself was a more considered political thinker, and a more active politician, than he has hitherto been given credit for, and that there were ideas around in influential conciliar circles that do not appear to reflect the ‘anti‐absolutist’ consensus that, it is widely claimed, prevailed within the early Stuart political nation.  相似文献

Abstract

The victory of the center left in the April 2006 elections was the product of a small numerical majority that has been translated into a slim parliamentary majority in the Senate. However, the difficulties of Prodi's government have deeper roots. This article explores the structural factors of Italy's never ending political and institutional transitions, both in the political and in the social sphere. Electoral and institutional reforms may help, but the crisis runs deeper because it also affects the authorities, their origin, their quality, their performance and the political community, its fragmentation and its anti-political beliefs.  相似文献

The reform of the East India Company following its acquisition of vast territories in Bengal in the mid 1760s raised hopes that it could provide Britain with a fund to alleviate the burdens of the national debt in the wake of the failure of American taxation. Concomitantly, it elicited genuine fears that the acquisition of such revenues and patronage by the state would radically augment the already overgrown ‘influence of the crown’. Studies of the parliamentary debates surrounding East India reform have consistently emphasized the house of commons as the principal scene of action. Inspired by the work of Clyve Jones in reasserting the centrality of the house of lords as a ‘pillar’ of the 18th-century constitution, this essay seeks to redress the balance, arguing that the Lords was a key arena through which co-ordinated parliamentary and extra-parliamentary activities and press campaigns altered the trajectory of the regulation and reform of the East India Company. Through the use of its distinct privileges, such as the right of opposition lords to protest any vote of the House and the right of peers to an audience with the monarch, as well as its determination to uphold its status as a mediator between the powers of the crown and the Commons, the upper chamber played a crucial role in shaping debates in the 1770s and 1780s over the future of the East India Company and its place in a burgeoning British Empire.  相似文献

The European Union (EU) spreads its norms and extends its power in various parts of the world in a truly imperial fashion. This is because the EU tries to impose domestic constraints on other actors through various forms of economic and political domination or even formal annexations. This effort has proved most successful in the EU's immediate neighbourhood where the Union has enormous political and economic leverage and where there has been a strong and ever‐growing convergence of norms and values. However, in the global arena where actors do not share European norms and the EU has limited power, the results are limited. Consequently, it is not only Europe's ethical agenda that is in limbo; some basic social preferences across the EU seem also to be unsustainable. Can Europe maintain, let alone enhance, its environmental, labour or food safety norms without forcing global competitors to embrace them? The challenge lies not only in enhancing Europe's global power, but also primarily in exporting rules and norms for which there is more demand among existing and emerging global players. This means that Europe should engage in a dialogue that will help it to establish commonly shared rules of morality and global governance. Only then can Europe's exercise of power be seen as legitimate. It also means that Europe should try to become a ‘model power’ rather than a ‘superpower’, to use David Miliband's expression. The latter approach would imply the creation of a strong European centre able to impose economic pains on uncooperative actors. The former would imply showing other actors that European norms can also work for them and providing economic incentives for adopting these norms. To be successful in today's world, Europe needs to export its governance to other countries, but it can do it in a modest and novel way that will not provoke accusations of ‘regulatory imperialism’.  相似文献

Abstract

When the Rhodesian Front Party under Prime Minister lan Smith declared unilateral independence (UDI) from Britain on November 11 1965, the international community responded by imposing economic sanctions against the rebel regime. At the time, the British prime minister, Harold Wilson was convinced that given the smallness and the fragility of the Rhodesian economy, international economic sanctions would quickly bring Rhodesia to its knees. Sanctions did not succeed, in the short run, in bringing the Rhodesian economy to its knees, however, partly because South Africa and Portugal refused to participate in sanctions and helped Rhodesia circumvent sanctions. This study examines South Africa's economic support for Rhodesia in the early years of Rhodesia's unilateral declaration of independence. It argues that South Africans defied international opinion over the Rhodesian question partly because of the widespread sympathy for their kith and kin across the border that were fighting the same battle against black nationalism as the South African ruling party, but also because of South Africa's need to protect and promote national interests through a demonstration of the inefficacy of international sanctions and boycotts at a time when it was, itself, a possible target for international sanctions because of its apartheid system.  相似文献

Benjamin Disraeli described Thomas Attwood as a ‘provincial banker labouring under a financial monomania’. The leader of the Birmingham Political Union, Attwood's Warwickshire accent and support for a paper currency were widely derided at Westminster. However, the themes of Attwood's brief parliamentary career were shared by the other men who represented Birmingham in the early‐ and mid‐Victorian period. None of these MPs were good party men, and this article illuminates the nature of party labels in the period. Furthermore, it adds a new dimension to the historical understanding of debates on monetary policy and shows how local political identities and traditions interacted with broader party identities. With the exception of Richard Spooner, who was a strong tory on religious and political matters, the currency men are best described as popular radicals, who consistently championed radical political reform and were among the few parliamentary supporters of the ‘People's Charter’. They opposed the new poor law and endorsed factory regulation, a progressive income tax, and religious liberty. Although hostile to the corn laws they believed that free trade without currency reform would depress prices, wages and employment. George Frederick Muntz's death in 1857 and his replacement by John Bright marked a watershed and the end of the influence of the ‘Birmingham school’. Bright appropriated Birmingham's radical tradition as he used the town as a base for his campaign for parliamentary reform. He emphasized Birmingham's contribution to the passing of the 1832 Reform Act but ignored the currency reformers' views on other matters, which had often been at loggerheads with the ‘Manchester school’ and economic liberalism.  相似文献

This article analyses the gravity and reasons for the crisis currently affecting the French Socialist Party. Going beyond the electoral disasters of 2014, it situates this crisis within the context of the destabilisation of the French party system due to growing divisions on the left and on the right caused by the evolution of the European Union in the current context of economic crisis. The left/right cleavage that structures the functioning of the political system is being called into question by an alternative cleavage that increasingly opposes the supporters of European integration against their opponents. The cross-cutting nature of these two cleavages will henceforth prevent the left from uniting on a programme of government. Within the Socialist Party itself this phenomenon is a factor of serious division and, as a result, makes the government's parliamentary base more fragile. It further deepens the long-standing differences on economic policy because of the explicit choice made by the Socialist government in favour of a supply-side approach. The Socialist Party seems to have arrived at the end of a political cycle where it will have to make choices that it has postponed for many years, with the risk of breaking up and with the threat of starting an electoral and political decline that could ultimately deprive it of its status as a party of government.  相似文献

Empowering backbench Members of Parliament in order to restore the effectiveness of the House of Commons has been a central theme in Canadian parliamentary reform for at least fifty years, but results are widely seen as disappointing. This article argues that unrealistic expectations, fostered by adherence to a traditional conception of the Westminster model of representative and responsible government, are part of the problem. A modernized conception of parliamentary government, recognizing the House as a forum for competing political parties between elections, could help us to better understand the House and improve its contribution to democratic governance. The proposed approach suggests innovative procedural options for legislative debate, Question Period, and other activities. It also offers a consistent basis for addressing issues such as floor-crossing, coalitions, and prorogations. More broadly, it points to the need for an integrated approach to the House, elections, political parties, public education, and citizen engagement in order to respond to contemporary democratic challenges.  相似文献

In 1903, Joseph Chamberlain launched a campaign aimed at the economic and political union of portions of the British empire behind a system of tariffs. The attack on Britain's 60‐year‐old system of free trade led to a polarising of opinion and sparked fierce controversy in the political sphere. It also shattered the unity of the Unionist Party, dividing it into three factions. One faction supported Chamberlain's policy, a second a more moderate policy proposed by party leader, Arthur Balfour, and a third – the smallest – the fiscal status quo. This article concerns this last faction, its motivations, actions and effectiveness. It argues that its concern with parliamentary alliances and methods, rather than the mass campaigns that were launched by its fellow opponents of Chamberlain, not only meant it was always bound to fail in its objectives, but made the problems of the Unionist Party far worse than they might otherwise have been. It concludes that the main reason why it failed to stop, or even delay Chamberlain's domination of the Unionist Party, not to mention suffering serious electoral losses, was largely due to its own incompetence in failing to grasp the new reality of mass politics and the need for new political approaches to deal with it.  相似文献

Recent applications of Foucauldian categories in geography, spatial history and the history of town planning have opened up interesting new perspectives, with respect to both the evolution of spatial knowledge and the genealogy of territorial techniques and their relation to larger socio-political projects, that would be enriched if combined with other discursive traditions. This article proposes to conceptualise English parliamentary enclosure–a favourite episode for Marxist historiography, frequently read in a strictly materialist fashion–as a precedent of a new form of sociospatial governmentality, a political technology that inaugurates a strategic manipulation of territory for social change on the threshold between feudal and capitalist spatial rationalities. I analyse the sociospatial dimensions of parliamentary enclosure’s technical and legal innovations and compare them to the forms of communal self-regulation of land use customs and everyday regionalisations that preceded it. Through a systematic, replicable mechanism of reterritorialisation, enclosure acts normalised spatial regulations, blurred regional differences in the social organisation of agriculture and erased the modes of autonomous social reproduction linked to common land. Their exercise of dispossession of material resources, social capital and community representations is interpreted therefore as an inaugural logic that would pervade the emergent spatial rationality later known as planning.  相似文献

In 2011, Australia communicated a clear choice about its strategic future. It would continue to cleave tightly to the US alliance, expand its military links and work to advance the USA's conception of regional order. Given its economic interests, why has Australia bound itself to the US alliance? What lies behind this strong commitment and what would it take for Australia to change its relationship with the USA? This article presents an analysis of the current state of the US–Australia alliance and argues that Canberra's pursuit of close relations with the USA reflects the interaction of a rational calculation of the costs and benefits of the alliance with a set of resolutely political factors that have produced the current policy setting. The article first assesses the security cost and benefit behind the alliance. It then argues that the move also derives from the strong domestic support for the US alliance, a sharpened sense that China's rise was generating regional instability that only the US primacy could manage and the realisation that the economic fallout of such a move would be minimal. It concludes with a brief reflection on what it might take to change the current policy settings.  相似文献

The Australian Senate is a significant part of the Australian parliamentary system and the electoral contest for the Senate results in representational outcomes that will influence the way the Senate will perform. This paper argues that the 2004 half-Senate election result was significant because it resulted in the Liberal–National Coalition obtaining a majority in the upper house. It accounts for this outcome by examining the contest by way of inter- and intra-party bloc contests. It finds that a particularly strong Right-of-Centre performance in Queensland, to which voters voting for Ms Pauline Hanson made a major contribution, delivered the Senate majority to the Howard government. The significance of the result also lies in the way it confounded previously held views that the combination of proportional representation used for the Senate with the need to elect six senators from each State would make it unlikely for either Labor or the Liberal and National Parties to ever win an upper house majority in the future.  相似文献

This article argues that Japan matters crucially in the evolving East Asian security order because it is embedded both in the structural transition and the ongoing regional strategies to manage it. The post‐Cold War East Asian order transition centres on the disintegration of the post‐Second World War Great Power bargain that saw Japan subjecting itself to extraordinary strategic constraint under the US alliance, leaving the conundrum of how to negotiate a new bargain that would keep the peace between Japan and China. To manage the uncertainties of this transition, East Asian states have adopted a three‐pronged strategy of: maintaining US military preponderance; socializing China as a responsible regional great power; and cultivating regionalism as the basis for a long‐term East Asian security community. Japan provides essential public goods for each of these three elements: it keeps the US anchored in East Asia with its security treaty; it is the one major regional power that can and has helped to constrain the potential excesses of growing Chinese power while at the same time crucially engaging with and helping to socialize China; and its economic and political participation is critical for meaningful regionalism and regional integration. It does not need to be a fully fledged, ‘normal’ Great Power in order to carry out these roles. As the region tries to mediate the growing security dilemma among the three great powers, Japan's importance to regional security will only grow.  相似文献

This article analyses the presentation of the Commons’ Speaker in the Tudor age. It traces the medieval origins of this ceremony, arguing that it served not only as an opportunity for flamboyant rhetoric, but also as a politically significant event designed to impress upon the Commons its inferiority in the parliamentary hierarchy. The article also suggests that Elizabethan Speakers used their orations as a means of presenting counsel to the queen herself.  相似文献
