The law and constitution of the family has been targeted for transformation in recent years, leading most notably to the Supreme Court's decision in Obergefell v. Hodges, mandating same-sex marriage as a matter of constitutional law. In this essay I undertake a thought experiment, asking how advocates of traditional marriage ought to want the law of marriage to change in light of this development. I begin by reviewing the argument for legal change sketched by Aquinas and then applying it to developments concerning marriage in modern America. Next I sketch the natural-law argument on behalf of traditional marriage. Finally, I turn to the case of Michael H. v. Gerald D., in which the Supreme Court upheld a statutory reiteration of the common-law presumption that the husband of the mother is the father of her child, against a challenge from the biological father, suggesting that this case, long admired by conservatives, needs to be reconsidered—and that the dissent in the recent Indian Adoption Case recognizing a constitutional right of biological parents might prove useful to the restoration of marriage law.  相似文献

The Paraguayan parliamentary coup against Fernando Lugo in 2012 fired the opening shot (following the CIA-induced removal of Honduras’s Manuel Zelaya in 2009) in the series of reversals of ‘pink tide’ politics throughout much of Latin America, most notably Brazil. But the Paraguayan case, argues art critic and former Minister of Culture Ticio Escobar, also has several particularities, such as the incapacity of Left and Right alike to construct enduring hegemonies after the collapse of the Stroessner dictatorship in 1989, as well as the increasingly potent shadow cast over the national political landscape by narco-capital. The still-unresolved massacre of peasant protesters at Curuguaty, which sparked Lugo’s overthrow only a week later, functions as an almost Brechtian theatricalization of these force-fields that have dominated Paraguay ever since the Triple Alliance War (1865–1870).  相似文献

Work placements are a well-established part of the curricula of many geographical sciences, as are opportunities for online learning. Whilst many aspects of the learning experience for undergraduates have been given an online makeover the placement has remained a ‘real’ experience. This paper considers the potential value of an online placement and outlines pedagogical and technical aspects of the e-MapScholar Virtual Placement. Findings from evaluation of the first Virtual Placement case study are presented and issues regarding wider adoption are raised.  相似文献

Abstract

The recent publicity surrounding the proposed construction of a wind farm close to the Medieval Agincourt battlefield in France has provoked an outcry suggesting that, once again, a European historic battlefield is at risk. A recent archaeological survey on the Agincourt battlefield has, however, failed to find positive artefactual evidence of the conflict on the officially designated battlefield site. Using the available historical and archaeological data from Agincourt and evidence from the successfully surveyed Medieval battlefield at Towton, England, an interpretation can be proposed, which highlights an alternative location for the French-English battle of 1415. Unfortunately, if this hypothesis was confirmed it is possible that, in attempting to protect an incorrect site, the correct site is more likely to be left unprotected and might eventually be destroyed.  相似文献

The Responsibility to Protect doctrine (R2P), now ten years old, has been widely accepted at the international level. As the books under review demonstrate, debates around its legitimacy are over. Instead, we see a developing second generation of literature focusing on how the R2P needs to be understood more concretely in both academic and policy terms, as well as how it affects the linked issues of humanitarian intervention and state‐building. Within this literature, we see new and important questions emerging. These include how and when we should intervene and whether we can be successful at it; how we can assist states to ensure they fulfill their own responsibilities towards their populations; and where international authority lies. Unfortunately, the answers to these questions are hard ones. Implementation, and how it reflects embedded culture at the international level, may be as hard—if not harder—as introducing the doctrine originally.  相似文献

Torsion of the femur (ante- or retroversion) is a normal feature of the bone. It is related to the angular difference in orientation between the proximal and distal articulations. Torsion has been studied, both in vivo and in dry bone, using a variety of techniques, from a traditional goniometer to radiographs and tomography. Problems with the accurate measurement of the angle of femoral torsion have been encountered by many workers, resulting in a wide range of reported values. A pilot study was undertaken to attempt to demonstrate the difficulties in measuring the angle in dry bone. It was demonstrated that, using standard equipment, measurement of this angle has very poor reproducibility. Is it possible, therefore, to measure the angle of femoral torsion accurately?  相似文献

The article focuses on the neo-liberal model of elite residence in India—the high-rise, high-density condominium. The growing presence of this model as an expression of social mobility indicates the critical role played by this new housing type in relation to the socio-cultural transformations advanced by neo-liberalism. This article, then, is an architectural inquiry into this new residential type within the contemporary setting of globalisation. I employ the idea of physical and social thresholds as a conceptual tool to investigate the progress of this spatial and cultural typology, following its injection into the Indian architectural landscape. I explore the multiplicity of physical thresholds within its spatial planning as a signal of manifest social relationships of increasing complexity. The two case studies in the global node of Mumbai explored in this research represent the beginning and the peak of development of this gated housing type. The methods used include spatial analyses of the design of the condominiums, participant observation and a reading of marketing material. The findings reveal that what started as a global residential type devoid of socio-cultural overlays has now evolved into a residential form with deeply entrenched cultural hierarchies echoing many attributes of colonial elite-status building.  相似文献

It is uncontroversial that the invasion and occupation of Iraq involved the following errors: the misinterpretation of intelligence; the underestimation of the number of troops requisite for law and order; the disbanding of the Iraqi army; and indiscriminate debaathification of the civil service. The first error was one of imagination rather than virtue; the others were caused by ‘callousness”, impatience, and consequent imprudence. These vices were partly responsible for massive civilian casualties, which many wrongly assume to teach the fundamentally erroneous character of the invasion. Nonetheless, we should beware such moral flaws in tomorrow's policy‐makers and renounce the managerial mentality that fosters them. Another lesson is that, in so far as nation‐rebuilding requires substantial and long‐term commitments, it must command the support of the nation‐builder's domestic electorate; and to do that, it must be able to justify itself in terms of the national interest. From this we should not infer the further lesson that morality's reach into foreign policy is limited, since, according to Thomist ethics, the pursuit of the national interest can itself be moral. Finally, one lesson that we should not learn from Iraq is never again to violate the letter of international law and intervene militarily in a sovereign state without Security Council authorization. The law's authority can be undermined as much by the UN's failure to enforce it, as by states taking it into their own hands. It is seriously problematic that the current international legal system denies the right of individual states to use military force unilaterally except in self‐defence, while reserving the enforcement of international law to a body, whose capacity to act is hamstrung by the right of veto. Given this situation, military intervention without Security Council authorization could be morally justified on certain conditions.  相似文献
