States have increasingly taken leading roles in U.S. environmental policymaking over the past two decades. As laboratories of democracy, states have developed different levels and mixes of policies to address climate change, nonpoint source pollution, alternative energy, and other challenging environmental issues. Policy scholars have sought to explain variation in state environmental policy through two primary theoretical lenses: internal determinants and regional diffusion. While our understanding of state environmental policy adoption has grown to identify which variables are most important, less is known about how these variables interact in particular states to influence policy adoption. This study examines the interactions of variables from both theories to explain how state policies for small‐scale wind energy promotion were adopted in three U.S. states. Our results highlight the nuanced role of citizen ideology, which may be important in contexts at either end of the ideological spectrum but less important in the middle—where economic development is more critical. Results also indicate that interstate competition may be over environmental as well as economic leadership. Interestingly, strength of the wind resource is not necessarily correlated with policy adoption for small‐scale wind energy promotion.  相似文献

Since 2001, state governments have adopted 287(g) cooperative immigration enforcement agreements with the federal government that authorize their law enforcement personnel to assist in detaining violators of civil federal immigration law. Employing a theoretical framework drawn from theories of policy adoption, intergovernmental relations, and immigration research, we test which state‐level political, sociodemographic, geographic, and economic determinants influence states to enter into such a cooperative agreement. In addition to finding that the partisanship of a state's governor, a state's effort on public welfare, and an increase in a state's percentage of Hispanics are related to the adoption of a cooperative immigration enforcement policy, we found evidence of “steam valve federalism” working not at the state level as Spiro (1997) first theorized but at the local level. When a state's localities adopt immigration enforcement agreements with the federal government, the state itself is far less likely to adopt their own. Understanding the reasons states would adopt this type of policy sheds light on current trends in state immigration policy and their effect on future state/federal intergovernmental relations.  相似文献

This analysis of the patterns of change in the use of incarceration by the American states from 1890 through 2008 focuses on multiple themes particularly relevant to an understanding of policy arenas in which the social constructions of target populations play an important role. Specifically, the study examines whether the states have adopted more similar incarceration levels over time (converged), whether they tend to change in the same direction at the same time (synchronous change), and whether they tend to stay in the same relative positions vis‐à‐vis one another, such that the historical policy position has long‐term implications for later policy positions (“feed‐forward” effects). The results indicate that, in spite of a century of social, political, and economic integration, the policy positions of the states have not exhibited a sustained convergence toward a common level of incarceration, but have undergone cycles, with some periods of convergence followed by periods of divergence. Change has generally been synchronous—as states tend to move in the same direction at the same time as if propelled by national forces even though incarceration levels are determined by state and local policy and the use of discretion by criminal justice officials. The results also indicate a profound “feed‐forward” effect in that the position of the states vis‐à‐vis one another historically has substantial predictive power for their position in subsequent years.  相似文献

We assess the tendency for the public to use group‐centric policy evaluations with evidence from a survey experiment concerning two issues within the social policy domain, health care and aid to cities. By randomly varying target group identity within each issue and using both negatively and positively regarded groups our evidence shows that differences exist in the tendency for members of the public to use group‐centric heuristics. Group‐centric evaluations are related to party identification and political ideology. Across both issues conservatives and Republicans are more likely than liberals or Democrats to adopt a group‐centric heuristic. Partisan and ideological differences suggest that established theories miss the mark by emphasizing how universal policy designs are preferred to designs that target unpopular groups.  相似文献

What factors account for local government land use practices and their choices among specific growth management policy instruments? We apply the political market framework to examine how land use policy choices in Florida are shaped by institutional features of county governments and the demands of organizations and interests in a community. Local policy decisions reflect a balance of the conflicting interests and responses to economic and political pressures. The results demonstrate that county government structure and election rules play critical roles in the adoption of urban service boundaries, incentive zoning, and transfer of development rights programs. We report evidence consistent with the argument that these “second‐generation” growth management policies are motivated by exclusionary goals.  相似文献

Having been adopted by legislatures in over a dozen states, postsecondary merit aid programs are largely concentrated in the southeastern United States. The observed clustering pattern seems to support previous evidence that policies spread between proximate states, a phenomenon referred to by political scientists as policy diffusion. Often, however, policy diffusion is not complete, and one or more states in a region fail to adopt. By interviewing policymakers throughout the southeastern United States—including actors in the three states in the region without merit aid—the study addresses the following question: Why do diffusion pressures lead to adoption in some states but not in others? Studying state “hold‐outs” promises not only to uncover the reasons for failed legislation in specific state contexts but also to better our understanding of the limits of diffusion theory.  相似文献

Public policy has been a prisoner of the word “state.” Yet, the state is reconfigured by globalization. Through “global public–private partnerships” and “transnational executive networks,” new forms of authority are emerging through global and regional policy processes that coexist alongside nation‐state policy processes. Accordingly, this article asks what is “global public policy”? The first part of the article identifies new public spaces where global policies occur. These spaces are multiple in character and variety and will be collectively referred to as the “global agora.” The second section adapts the conventional policy cycle heuristic by conceptually stretching it to the global and regional levels to reveal the higher degree of pluralization of actors and multiple‐authority structures than is the case at national levels. The third section asks: who is involved in the delivery of global public policy? The focus is on transnational policy communities. The global agora is a public space of policymaking and administration, although it is one where authority is more diffuse, decision making is dispersed and sovereignty muddled. Trapped by methodological nationalism and an intellectual agoraphobia of globalization, public policy scholars have yet to examine fully global policy processes and new managerial modes of transnational public administration.  相似文献

Since the late 1960s, the number and types of organized interest groups working at the state level have increased dramatically, but research shows that traditional organized interest groups, such as business and labor unions, are still the most influential in state policymaking ( Thomas and Hrebenar 1996 ). Less is known, however, about the influence of non‐economically focused interest groups in the state policy process. Using pooled cross‐sectional data from the American states, I explore the effect that nontraditional organized interests can have on state policy. Specifically, I examine the influence of the Humane Society of the United States on state adoption of animal cruelty felony laws. Although the Humane Society is not one of the traditional groups expected to have a significant influence in state policymaking, my results suggest that it has played a significant role. However, I also find that the Humane Society's influence on the stringency of these laws is less pronounced.  相似文献

Policy feedback scholarship has focused on how laws and their implementation affect either organizations (e.g., their resources, priorities, political opportunities, or incentive structures) or individuals (e.g., their civic skills and resources or their psychological orientations toward the state). However, in practice the distinction between organizations and individuals is not clear‐cut: Organizations interpret policy for individuals, and individuals experience policy through organizations. Thus, scholars have argued for a multi‐level model of feedback effects illuminating how policies operating at the organizational level reverberate at the individual level. In this theory‐building article, we push this insight by examining how public policy influences nonprofit organizations’ role in the civic life of beneficiaries. We identify five roles that nonprofit organizations play. For each role, we draw on existing research to identify policy mechanisms that either enlarge or diminish nonprofits’ capacity to facilitate individual incorporation and engagement. From these examples, we derive cross‐cutting hypotheses concerning how different categories of citizens may need policy to operate differently to enhance their civic influence; whether policy that is “delivered” through nonprofits may dampen citizens’ relationship with the state; and how the civic boost provided by policy may be influenced by the degree of latitude conferred on recipient organizations.  相似文献

Abstract: New state spaces can be seen as products of the interaction between emerging initiatives and pre‐existing institutional arrangements ( Peck 1998 , Space and Polity 2:5–31). In the devolved territories of the UK devolution has created new political centres of policy formulation and this paper is concerned with how devolved policy initiatives are reshaping and rescaling sub‐national spaces of governance. We focus on the rescaling of transport governance in Scotland through a nationally orchestrated process of regionalisation involving the creation of Regional Transport Partnerships (RTPs), an initiative that has been shaped by tensions between changing national political objectives and local interests. Our approach draws on Neil Brenner's “new state spaces” (NSS) framework, which has value in emphasising the historically embedded and path‐dependent nature of restructuring processes. At the same time, its abstract nature leads the NSS approach to privilege the broad processes that generate new configurations of state power over the complex politics associated with the restructuring of particular spaces. In response, we suggest a new theoretical synthesis that draws NSS together with the ancillary notions of “regional armatures” and “the politics of scale” to provide a stronger purchase on the political agency and struggles that “form” and “mould” particular spaces.  相似文献

Policy diffusion literature generally studies the adoption of similar policies across jurisdictions, but often overlooks how opposing policies or legal constraints may influence the enactment of rigid state constitutional amendments. The current study models the spread of state constitutional amendments designed to prevent future policy change. Using conditional event history analysis on all states from 1999 to 2011 the empirical models analyze the spread of same‐sex marriage prohibitive amendments across the United States. Findings suggest that the nearby adoption of opposing policies encourage state legislatures to introduce prohibitive amendments. The regional diffusion effect suggests that policymakers “protect” their jurisdiction from nearby diffusion forces or seek electoral gains by symbolic protection by committing an already existing policy into the rigid state constitutional framework. Regional policy diffusion may, therefore, be explained by a countermovement mechanism unique to the state constitutional amendment process. This protective strategy among state legislatures and citizens may explain why many policy areas are frequently codified in state constitutions.  相似文献

The politics of so‐called “morality policies” including same‐sex marriage, abortion, gun control, and gambling have captured the attention of both the public and political scientists in recent years. Many studies have argued that morality policy constitutes a category of public policy that has distinctive characteristics (such as technical simplicity and less amenability to compromise) compared with non‐morality policy. However, in a recent contribution Mucciaroni argues that morality “policy” should instead be viewed primarily as a strategy for framing issues. Drawing on examples from the debate over gay rights, Mucciaroni finds that opponents focus on rational‐instrumental or procedural frames more so than engaging in “morality talk.” In this study, I seek to extend Mucciaroni's analysis to the issue of lottery gambling in the United States. Drawing on data from legislative records in four states, I find that lottery critics mostly avoid private behavior‐based morality arguments. Instead, they criticize government's role in sanctioning lotteries and denounce the negative consequences of gambling. Supporters, meanwhile, emphasize the potential benefits of lottery creation and the importance of allowing the state public a voice on the issue. The results indicate that rational‐instrumental arguments coexist alongside morality talk in state lottery debates, and that private behavior morality frames are on the decline while governmental morality frames are on the rise.  相似文献

This article will critically appraise two approaches to cultural policy. The first focuses upon the need for a national cultural policy in order to establish a national “common culture” among its citizens, through measures to promote the arts and popular media sectors, and set limits to the flow of imported materials into the nation. This is what has been termed the “sovereignty” model, and has historically been the driver of cultural policy debates. The second approach, which is called the “software” approach, aims to create cultural infrastructure and other environmental factors to promote a creative economy, whether at local, regional, national or supra‐national levels. It questions the historical divides between “culture” and “industry”, and between “creativity” and “innovation”, and is focused upon the development of future ideas and creative concepts. It draws upon the very different conditions associated with the development of software to those of established arts and media sectors, and aims to extend the “software” model more widely into cultural and creative industries policy.  相似文献

ABSTRACT. This article elaborates on the concept of national reproduction as a means of analysing how national categories were redefined and adjusted in the political process that led to the establishment of the National Library of Norway. Three different forms of national reproduction may be distinguished in this process: the adjustment of cultural and territorial hierarchies within the nation‐state in the 1980s; the consolidation of the national community by defining it in contrast to the “foreign” in the 1990s; and the definition by the political elite of a “new national we” that includes the “foreign” after the turn of the millennium.  相似文献

Government reliance on voluntary programs represents a significant shift in public policy: moving from command and control regulations to market based mechanisms. This article explores the determinants of Voluntary Remediation Programs (VRPs) in the American States. During the 1980s and 1990s, 44 states adopted VRPs to facilitate remediation of existing hazardous waste sites. Relying on diffusion of innovation theory, I develop a model of state policy adoption that explores the influence of internal state political and economic factors, as well as testing the influence of regional and top‐down diffusion forces. I utilize a discrete‐time event history approach to test this model. The results indicate that state policymaking is responsive to interest group pressure and the pace of cleanup at hazardous waste sites. Additionally, state policymaking is consistently influenced by the actions of surrounding state governments; the probability of adopting a voluntary program increases if surrounding states have already developed these policies.  相似文献

There is a large body of literature devoted to how “policies create politics” and how feedback effects from existing policy legacies shape potential reforms in a particular area. Although much of this literature focuses on self‐reinforcing feedback effects that increase support for existing policies over time, Kent Weaver and his colleagues have recently drawn our attention to self‐undermining effects that can gradually weaken support for such policies. The following contribution explores both self‐reinforcing and self‐undermining policy feedback in relationship to the Affordable Care Act, the most important health‐care reform enacted in the United States since the mid‐1960s. More specifically, the paper draws on the concept of policy feedback to reflect on the political fate of the ACA since its adoption in 2010. We argue that, due in part to its sheer complexity and fragmentation, the ACA generates both self‐reinforcing and self‐undermining feedback effects that, depending of the aspect of the legislation at hand, can either facilitate or impede conservative retrenchment and restructuring. Simultaneously, through a discussion of partisan effects that shape Republican behavior in Congress, we acknowledge the limits of policy feedback in the explanation of policy stability and change.  相似文献

The recent debate on the Eurozone failed to appreciate a particular characteristic of European crisis experiences, namely their fundamentally political character. To make my argument, I borrow from Dani Rodrik (2000) the framework of a “political trilemma” between cross-border economic integration, national institutions and democracy (in the sense of mass politics) and discuss its relation to the more commonly known “macroeconomic trilemma” as well as some limitations of the framework. The recent experience of a European debt crisis and the experience of Europe's Great Depression can be interpreted as a “political trilemma”: both reflect the problem of designing effective policy responses to major economic shocks within the environment of deep economic integration across political boundaries and the regime choices that this involves. Within this framework I highlight some aspects of the 1930s that are informative to the policy choices in Europe today. Once we accept that some policy choices should be avoided, attention should be shifted to the remaining options and the obstacles that prevent their implementation, notably the challenge to transform democracy beyond national borders.  相似文献

While the number of charter schools has increased rapidly in the United States, few studies have examined whether charter schools are implemented in response to real and perceived educational needs or to political and institutional factors in the education policy arena. Unlike traditional policy adoption and diffusion studies that focus on the state level and use a dichotomous dependent variable—adoption or not—this article focuses on local school districts and uses the number of operating charter schools as the dependent variable. Accordingly, instead of applying event history analysis, this article conducts generalized event count regression to estimate models. Based on a data set that consists of Florida's 67 school districts across a six‐year time period, the results suggest that charter school diffusion is more heavily driven by political and institutional factors than by educational needs. The results also demonstrate a dynamic trend of charter school diffusion over time.  相似文献

A social analysis based on extensive evaluation of the Dance and Drama Awards programme reveals the social‐market political paradigm underpinning the formation of cultural policy in the UK underthe New Labour government. This specific intervention in the field of cultural production is placed in the context of broader government interventions in the cultural domain that seek to give respect to undervalued social and cultural groups. There is a political analysis of the characteristics of the social‐market political formation that underpin New Labour’s “affirmative” actions, and the political strategies informing the government’s “access” and “inclusion” agendas and their impact on the cultural and creative industries. The authors argue that the construction of a “social‐market” position in New Labour’s cultural policy represents an attempt to bridge or “hyphenate” the contradictory claims of social democracy, on the one hand, and economic fatalism, on the other. Despite the rhetoric of social and cultural “transformation”, the authors argue that a “faith” in the market prevents New Labour from transforming the political‐economic and cultural structures that generate economic and cultural injustices.  相似文献

In this paper, I apply Mettler's concept of the “submerged state” to aid for children at private schools in the United States, including education vouchers, in‐kind aid, and property tax exemptions. All aid policies are “submerged” in that they help private organizations take on state functions but some are more submerged than others. Theoretically, this paper distinguishes between subcategories of submergence. Using policy data from 50 states and an original database of court challenges between 1912 and 2015, I employ probit regression with sample selection to evaluate the effect of submergence on successful court challenge. I find that more submerged policies are less likely to be successfully challenged than less submerged policies. Submerged policy design enables supporters to avoid legal as well as political challenge.  相似文献
