论代议制民主思想的起源

代议制民主思想的一些基本要素是在中世纪漫长的历史过程中逐渐孕育形成的。它的基本内容包括:社会共同体是政治权力的最终来源;王权源于人民权力的转让,但人民仍保留着对它的所有权和终极控制权;公共权力的使用应以社会共同体的同意为基础,“关涉大家的事需得到大家的同意”应成为立法、建立政府及其他政治决策的基本原则;由各等级或社会团体选派的代表组成的机构能够行使共同体的政治权力,特别是立法权和征税权。本文从政治权力的来源、归属和行使等方面分析代议制民主思想的原初内涵及其在中世纪的起源与成长发育过程。     

Origins of Difference: Professionalization,Power, and Mental Hygiene in Canada and the United States

This study examines the emergence and development of mental hygiene professional organizations in Canada and the US by analyzing discursive differences in the publications of two sister committees: the National Committee for Mental Hygiene and the Canadian National Committee for Mental Hygiene. The analysis finds that while mental hygiene in North America initially emerged as a single, shared continental professional discourse, the two movements diverged in critical ways for reasons directly related to their institutional contexts and donor bases. Even as US popular and political discourse veered towards eugenic policies, the US mental hygiene discourse shifted sharply away from eugenics. In contrast, in Canada, mental hygiene publications focused increasingly on the moral dangers of Canada’s immigrant population and played a role in producing scientific legitimacy for eugenic policies. This analysis suggests that the different trajectories of the two professional communities have their origins in organizations’ membership and donor bases, not broader differences in national character.     

国民政府五院政体下的权力模式、领袖专权与外交制衡——对王正廷弹劾一案的史料解读与透视

本文考察的重点是发生在1931-1934年间,由国民政府监察院发起,对位至外交部长高位的王正廷进行的一桩弹劾案。由于该案在处置过程中几经曲折,该案的审理历时近3年,涉及机构既有国民政府、五院,也有中政会、中常会等国民党的权力中枢,关系人物涉及当时国民党党政两界的诸多名人显要。故从案例分析入手,利用原始档案文献对此案进行深入考察,不仅对国民党"党治"下五院政体的权力结构、运行和监督机制有重要的认识意义,对这一时期国民党上层人士间的复杂关系以及蒋介石对权力的驾驭和操控都是一个很好的揭示。     

Pride,Sensuality and Han: Revisiting Sin from the Underside

Abstract

This paper critically reconsiders the earliest feminist critiques of Reinhold Niebuhr's doctrine of sin and sketches out succeeding developments in feminist understandings of human sin and alienation. Borrowing the concept of "han" from Korean minjung theologians to name the experience of broken-heartedness/being sinned against that the feminist literature highlights, it argues that han can be a precondition (along with anxiety) for human sin. Finally, it asks whether there is room in Niebuhr's system for an understanding of han as a precondition for sin, and concludes that there is.

魏玛宪法二元制与希特勒的上台

在中外学术界对魏玛共和国灭亡与希特勒上台原因的研究中,人们一般都强调魏玛宪法二元制中总统权力的作用。本文认为,希特勒不仅是依靠以总统兴登堡为旗帜的德国保守势力,更是依仗着国会不可动摇的宪政地位上台的。魏玛宪法中国会与总统之间是势均力敌、难分难解的二元关系,正是这种二元制促成了希特勒的上台。

One of my strongest memories of law school remains the first class in “Federal Courts.” The teacher began by asking if anyone could explain the holding in Erie Railroad Co. v. Tompkins (1938).2 Several students raised their hands, and the answer was soon forthcoming. Federal courts were bound by the decisional rules of the state courts in the states in which theywere located; there is no federal common law. “Very good,” the teacher said. “If you know that, why are you taking this course?”
