In 1835, a statute was passed in the parliament of the United Kingdom making it illegal for a widowed man to marry his sister-in-law. 1 Lord Lyndhurst's Act (1835) 5 & 6 Will VI c. 54. Marriage to a sister-in-law after a wife's death was common practice in nineteenth-century England and colonial Australia and aunts often took on the responsibility of raising children after a sibling's death. In the 1840s, a protracted parliamentary and social debate began over whether a widowed man's marriage to his sister-in-law should be made legal and this debate lasted over seven decades. In the Australian colonies, where English law had been inherited, 2 Those Australian colonies settled prior to the passing of Lord Lyndhurst's Act inherited the English position regarding deceased wife's sister marriage at the time, that such unions were voidable in the ecclesiastical courts during the lifetime of the parties, and in those colonies established afterwards, the 1835 statute applied and deceased wife's sister unions were illegal. In both cases colonial parliaments attempted to pass legislation to clarify the law. a similar debate occurred in the 1870s. The marriage was legalised in most of Australia in the 1870s while it remained illegal in England until the turn of the century. The parallel debates in each country provide a window into the comparative effect of religious culture on the development of marriage law. One of the primary reasons for the protracted nature of the struggle for marriage reform in England was its significance for the relationship between church and state. This article explores the implications of the relationship between church and state in Britain and the colonies for marriage legislation.  相似文献

This paper examines colonial discourses on race, environment and global identity that arose during an outbreak of bubonic plague in the French Pacific settler colony of New Caledonia between December 1899 and April 1900. The outbreak of plague brought to the forefront colonial anxieties over living on the periphery of empire, definitions of what it meant to be white, the health menace posed by peoples the dominant colonial society categorised as non- white, and the danger the plague posed to the salubrious island environment that had just begun to attract free settlement after the end of the penal colony four years previously. These discourses were linked by the threat, real and imagined, posed by the bubonic plague, intersecting with the ambiguous place held by the outlying colony within the webs of a modern global commercial community and the Pacific world.  相似文献

Scholars of Argentine cinema have engaged extensively with the oppositional politics of the Nuevo Cine of the 1960s and ’70s, but much less with the cinema of that time that offered support to more conservative politics. In the interest of better understanding such support in mass culture, this essay contextualises the films made between 1970 and 1975 that star the pop idol Ramón “Palito” Ortega and examines how his star persona – which had been constructed through television, songs, magazines, and films – evolves through the first half of the decade, asking how this evolution is significant in the period’s turbulent context. In the films, Ortega functions as an avatar for a conservative bourgeois morality by delegitimising practices associated with, first, modern youth culture, then, after 1973, specific politically left practices, while exalting traditional practices that support social hierarchies compatible with the Peronist conservative orthodoxy. The essay finds that this process of politicisation runs from nostalgic nationalist reaction against modern internationalising youth culture to, with the legalisation and return to power of Peronism, examples of matter-of-fact anti-Communism and veiled anti-Semitism in affinity with the conspiracy theories propagated by the Far Right that took power in the pre-dictatorship period.  相似文献

Literature is produced within society and reflects social phenomena and therefore it must not be neglected in any interscientific approach to the way a certain geographical area contributes to the construction of an identity. The main purpose of this paper is to point to some directions concerning the study of the Mediterranean, by means of literary works. It is based on the example of Greece and presents a brief discussion through the history and certain themes of Greek literature (movement, traveling, experience of the refugees etc.), concentrating on the search for a national identity, towards either an introspective or a cosmopolitan point of view. The study is not exhaustive; it is indicative of the way literature, both from a contemporary and a general historical point of view, is able to express a more indepth research into the Mediterranean communities.  相似文献
