Abstract

The late Jefferson presents a puzzle to scholars. In his last years the author of the Declaration of Independence strongly opposed the Missouri Compromise and set important precedents for the political strategy of the antebellum South. This essay argues that these problematic aspects of Jefferson's career are more closely linked to his natural rights doctrine than is generally recognized and extend tendencies already present in Jefferson's draft of the Declaration. Unlike previous scholars who explain Jefferson's problematic politics by his racism or the inherent selfishness of Lockean natural right, I argue that the core flaw in Jefferson's natural rights doctrine is the encouragement it gives to self-righteousness. Because he responded to the problem of slavery in a spirit of angry self-defense, Jefferson's understanding of natural rights blinded him to the ways in which his actions strengthened slavery and undermined his own most cherished political achievements.  相似文献

SUMMARY

The Machiavellian Moment was largely responsible for establishing what remains the dominant understanding of American Revolutionary ideology. Patriots, on this account, were radical whigs; their great preoccupation was a terror of crown power and executive corruption. This essay proposes to test the whig reading of patriot political thought in a manner suggested by Professor Pocock's pioneering first book, The Ancient Constitution and the Feudal Law. The whig tradition, as he taught us, located in the remote Saxon past an ‘ancient constitution’ of liberty, in which elected monarchs merely executed laws approved by their free subjects in a primeval parliament. This republican idyll, whigs believed, was then tragically interrupted by the Norman Conquest of 1066, which introduced feudal tenures and monarchical tyranny. Did patriot theorists accept this narrative? The answer, I shall argue, is strikingly mixed. By the early 1770s, appeals to the ‘ancient constitution’ had become less common in patriot writing. And by the end of the 1770s, many patriots had absorbed a completely different understanding of the feudal past—one pioneered by Royalist historians of the seventeenth century and then adapted by Scottish historians of the eighteenth. This shift reflects a broader transformation in patriot political and constitutional theory.  相似文献

ABSTRACT

This paper explores and reevaluates the place of Plato in the history of liberty. In the first half, reevaluating the view that he invents a concept of ‘positive liberty’ in the Republic, I argue for two claims: (1) that he does not do so, insofar as this is not the way that virtuous psychological self-mastery in the Republic is understood, and (2) that the Republic works primarily with the inverse concept of slavery, relying on entrenched Greek ideas about the badness of the status of being a slave and the actions and dispositions associated with it. Turning in the second half to seek Platonic innovation not in the domain of ‘positive liberty’ but in reflection on liberty as a political value, understood as the liberty of action of citizens within the laws, I argue for two further claims: (3) that as such a political value, liberty is limited and reshaped in both the Republic and the Laws to be compatible with obedience to rule / willingness to be ruled, ideally willing obedience; and (4) that for this limited and reshaped value to be secured, such obedience must be manifested not only in regard to a constitution’s laws, but also to the magistrates who hold office within it.  相似文献

Abstract

Arendt and Tocqueville both celebrate a participatory notion of political freedom, but they have a fundamental disagreement about the role that political education should play in fostering an active citizenry. I contrast Tocqueville's “educative” conception of politics with Arendt's “performative” conception, and I explore an important but little-noted difference between the two theorists: whereas Tocqueville argues that it is the task of statesmen “to educate democracy,” Arendt warns that those who seek to “educate” adults are inappropriately aspiring to be their “guardians.” I argue that although Arendt's warnings about the dangers of intertwining politics and education are at times salutary, Tocqueville is ultimately correct that education must be a key task of democratic leadership, and he is right to suggest that politics can itself be educative in crucial ways.  相似文献

Abstract

I locate the Leveller John Lilburne within the broader literature on the history of political thought and I challenge scholars who associate Lilburne's Leveller political thought with Hobbesian liberty, with proto-libertarianism, or with proto-bourgeois political thought. I advance an understanding of Lilburne as creatively merging central tenets of proto-liberalism with central tenets of republicanism. To develop this amalgamation of ideas, I go considerably beyond the Agreement of the People and the Putney Debates to explore the larger Leveller corpus. Through this investigation I articulate Lilburne's account of key concepts in the history of political thought including: liberty, tyranny, rights, rule, political participation, popular sovereignty, civic virtue, self-interest, harmony, antagonism, and institutional design. I conclude by arguing that we should consider the Levellers, particularly John Lilburne, as offering an early example of what has come to be called liberal-republican political thought, a way of theorizing found within the writings of English Commonwealthsmen.  相似文献

Summary

In his early years Herder is known to have been a follower of Rousseau (via Kant). This article argues that there was indeed a substantial overlap between Herder's and Rousseau's ideas in Herder's early writings, particularly in terms of their joint critique of abstract philosophy and their understanding of the sentimental foundations of morality, as well as their commitment to the ideals of human moral independence and political freedom. Yet Herder's admiration for Rousseau's moral philosophy did not lead him to adopt Rousseau's critique of sociability even in this early period, and there was in fact a deep divergence between their political views. Herder attempted to combine a Rousseauian cultural critique, ‘human’ moral philosophy and philosophy of education with ideas inspired by Thomas Abbt's theory of monarchical patriotism. In contrast to Rousseau, and following Abbt, Herder posited the existence of natural patriotic feelings and underlined their importance in guaranteeing good government and political freedom. Thus, Herder could have a relatively optimistic view of the role of ‘human philosophy’ in regenerating patriotism in a modern setting. Herder embraced Abbt's emphasis on the positive aspects of modern monarchies and ‘modern liberty’ when compared to ancient republics, highlighting the compatibility of Christianity, international commerce and religious tolerance, and the general possibility of developing one's natural inclinations in modern monarchies.  相似文献

ABSTRACT

The role of resistance in the politics of modern representative democracies is historically contested, and remains far from clear. This article seeks to explore historical thinking on this subject through a discussion of what Benjamin Constant and Alexis de Tocqueville had to say about resistance and its relationship to ‘representative government’ and democracy. Neither thinker is usually seen as a significant contributor to ‘resistance theory’ as this category is conventionally understood. But, in addition to their more familiar preoccupations with securing limitations on the exercise of political authority and averting majority tyranny, both thinkers wrote extensively on the nature and meanings of resistance in ‘representative governments’ or democratic societies. Both thinkers are examined in the context of revolutionary and Napoleonic discussions about the legitimacy of resistance or ‘right to resist’ oppression, and against eighteenth-century discussions of the ‘spirit of resistance’ since Montesquieu. The article notes conceptual distinctions between resistance, revolution and insurrection in the period, and addresses the broader question of the extent to which early nineteenth-century French liberals sought to ‘institutionalise’ principles of resistance within modern constitutional frameworks.  相似文献

In this article it will be argued that François Furet's attempt in Interpreting the French Revolution to provide a conceptual history of the French Revolution through a synthesis of Tocqueville and Cochin's historical and sociological accounts fails methodologically. It does so in two ways: Firstly, in its aim to distinguish between conceptual, explanatory history and empirical, narrative history, and secondly, in its distinction between revolution as process and revolution as act. Drawing on Claude Lefort and Paul Ricoeur's interventions in the historiographical debate, I demonstrate that these seemingly methodological concerns, conceal a deeper historical and political question concerning the nature of the ‘event’ of revolution. In response to Furet's oblique turn to Hegel in his later work, this article traces the nature of the ‘conceptual inversion’ Furet claims to find in Hegel and Marx's accounts of the French Revolution. In relation to Marx, it is argued that Furet's critique fails to capture the allegorical nature of the political in Marx's thought, and underplays the significance of revolution as the basis for both the separation of the social and the political and their attempted unity. The article ends with some remarks on the importance of language and culture in rethinking the relationship between Hegel and Marx.  相似文献

ABSTRACT

This article contextualizes, explores, and compares a selection of writings on party government and the modern State authored throughout the 1880s by two major representatives of post-Risorgimento Italian liberalism – Silvio Spaventa (1822–1893) and Marco Minghetti (1818–1886). Its comparative analysis unveils two alternative paths for taming factionalism and securing political freedom in modern representative governments: the strategy of monism pursued by Spaventa, revolving around the primacy of the State and its unity; and the strategy of pluralism championed by Minghetti, praising self-government and the multiple associations that enliven civil society. It connects these strategies to the intellectual background of the two authors – the importance of Hegel’s ideas for Spaventa; the implications of Tocqueville’s anti-Hegelianism for Minghetti – and maps them onto their visions of party government. In doing so, it retrieves an important chapter in the Italian debates on parties that has received scarce consideration among Anglophone scholars. It also helps to pluralize our understanding of Italian liberalism(s) in the aftermath of the Risorgimento. Finally, it draws the attention of Anglo-American political theorists and historians to Minghetti’s seminal book I partiti politici e l’ingerenza loro nella giustizia e nell’amministrazione (1881), which offered the first systematic analysis and defense of parties, and their difference from factions, in the history of modern Italian political thought.  相似文献

Having first met in 1835, John Stuart Mill and Alexis de Tocqueville began ‘an extremely interesting and mutually laudatory correspondence'; but their splendid friendship did not last. A popular thesis focuses on letters exchanged in 1840 to 1842 that reflect conflicting views on the Eastern Question and argues that Mill initiated the ‘strange interruption’. Given Mill's commitment to the ‘agreement of conviction and feeling on the few cardinal points of human opinion’ as a prerequisite of genuine friendship, such interpretation sounds plausible. However, circumstantial evidence, most notably Mill's willingness to have a frank discussion with Tocqueville on pending issues, contradicts the assertion that Mill was enraged by Tocqueville's 1841 letter. This essay suggests focusing attention on two additional cardinal differences between them—their contrasting views of François Guizot and confrontation vis-à-vis benevolent imperialism. Moreover, personal matters such as Harriet Taylor's dislike of Tocqueville and Mill's departure from the London and Westminster Review are also believed to have largely led to Mill discontinuing correspondence with Tocqueville.  相似文献

ABSTRACT

Free versus unfree was a fundamental axis of differentiation in ancient Near Eastern societies. Liberty was conceptualized as the power to govern oneself, free from another's domination, thus free to participate in constituting political authority. More concretely, the subject of the state was by definition free, this being the condition of obliging him for duty. Thus the relation between people and polity was predicated on liberty, not servitude as commonly supposed of an area still shackled to the Western ideology of Oriental despotism. I argue that liberty was an operative principle in the organization of ancient Near Eastern polities, basing the case on sources from the Late Bronze Age. The first section sets forth general propositions, and the second puts them in ancient Near Eastern terms. The third and fourth sections examine documents from Ugarit and Emar, two polities under Hittite suzerainty, that illustrate how these principles operated in the lives of individuals. The fifth section examines how they were articulated at the scale of communities, through the lens of the poet(s) who composed the Hurro-Hittite ‘Song of Liberation'. The conclusion draws together the ideas of liberty, bondage and liberation these sources disclose, ideas that remained productive in later ages.  相似文献

ABSTRACT

The philosophical debates that unfolded in Enlightenment Britain left a deep mark on the mindset of future generations of thinkers. A clear echo of eighteenth-century disputes over the meaning of human liberty is heard in the subsequent confrontation between materialists and idealists. In more recent times, a number of arguments developed by compatibilist and incompatibilist philosophers still resemble more old-fashioned positions. However, the aim of this paper is to evaluate the differences between Joseph Priestley’s defence of “necessitarianism” and Thomas Reid’s elaboration of counterarguments to support “metaphysical liberty” – as the two doctrines were known in the late eighteenth century – on the background of their methodological assumptions and the different styles of their reasoning. I contend that a different adoption of the Newtonian scientific method, which they brought to bear on the study of the human mind, is key to understanding the way they endeavoured to defend necessity and liberty, respectively. I also argue that their interpretation of the nature of causality importantly shaped the arguments they put forth in attacking each other’s position.  相似文献

Nearly two centuries after its publication, Alexis de Tocqueville's Democracy in America (1990a) remains among the most influential accounts of American political culture. This essay argues that the rhetorical foundation of the Democracy's enduring cultural power is its “imaginative geography” (Said 2000), about which I make two, interrelated claims. The first has to do with the Democracy's identification of the American land with divine Providence. I claim that the providential landscape is the chief means by which Tocqueville contains and organizes the account of the tension between achieved liberty and natural freedom that drives the Democracy. My second focus is on the romantic character of the providential landscape. Cosgrove (2005, p. 302) reflects upon the “tenacity of the island condition on the Western imagination” as frame and vessel of “imagination, desire, hopes and fears.” I argue that the Democracy's “Inland Isle,” as I call it, is a metaphorical island in this sense, and that its theoretical capacity and exhortative power derive from Tocqueville's use of an idiom expressive of a distinctively French tradition of landscape theorizing in which garden metaphor was used to construct meanings of equality and freedom, and voice and identity, in an emerging national, bourgeois order.  相似文献

During the years he was involved in French parliamentary politics, Alexis de Tocqueville was obsessed with the issue of political corruption. This article presents the first sustained analysis of Tocqueville’s speeches and writings on French corruption. It examines Tocqueville’s initial encounter with corruption during his run for parliamentary office, his sophisticated account of the sources of corruption, and his strategies for reforming French politics. The article contends that taking seriously Tocqueville’s struggle against corruption has the effect of complicating several conventional interpretations of his thought. In his speeches and writings on corruption Tocqueville shows himself remarkably willing to compromise with, even to work with, centralisation. And he argues that in a nation like France which lacks substantial local self-government, a vibrant parliamentary politics could be an effective means for promoting energetic civic participation.  相似文献

Political theorists recently focused their attention on the history of the idea of constituent power. This, they claim, shows that the notion of pouvoir constituant expressed the radical and absolute power of the sovereign people. In other words, constituent power pointed at the democratic and irresistible core of popular sovereignty. In this paper, I argue that the analysis of nineteenth-century French political thought offers a different account of constituent power’s history. Relying upon archival resources, I show that in the aftermath of the French Revolution politicians and legal scholars used constituent power to tame the very idea of sovereignty and the powers from it derived. First, during the Restoration constituent power was used to pose a limit to the power of the monarch. Second, throughout the July Monarchy scholars resorted to constituent power to oppose the Parliament's claim to be the sovereign power and the only legitimate author of the constitution. Moreover, they also used it to claim that claim that, even if the people was sovereign, its power was restricted to authorizing the constitution. Third, during the Second Republic, jurists and politicians addressed the people’s sovereign power in terms of constituent and constituted power. While the first was meant to disappear after the constitution’s approval, the second was a second-order power limited by the hierarchy of norms and the rigidity of the constitution.  相似文献

In George Orwell’s 1984, the poet Ampleforth observes that “the whole history of English poetry has been determined by the fact that the English language lacks rhymes.” In this article I connect Ampleforth’s observation to Orwell’s many other writings on language and political control and then show how Orwell’s discussion of poetry’s resistance to political manipulation enhances Tocqueville’s and Burke’s accounts of totalitarianism. Specifically, Orwell illustrates how an easily “rhyming” polity is particularly vulnerable to totalitarian politics, while a society containing considerable disorder in its language and politics can be strongly resistant to such tyranny.  相似文献

This essay traces the Greek and Roman roots of Polish sixteenth- to eighteenth-century political thought by discussing the Polish nobility’s concept of the “Golden Freedom” (L. aurea libertas). By focusing on the Roman and the Greek concepts of liberty and the mixed constitution, it argues that the Golden Freedom, a notion central to the Polish-Lithuanian nobility’s self-identification, was based on Roman political ideals and practices that were incompatible with the political reality of the Commonwealth.  相似文献

Alexis de Tocqueville’s political thought is often seen as inconsistent for offering two apparently dissimilar theories of revolution. The first is universal democratisation, understood as a social phenomenon and a grand revolutionary change; the second sees revolution as the logical continuation and radicalisation of the preceding regime. The following question arises: was Tocqueville inconsistent in his principal works? I argue that this was not the case and that the two processes are complementary elements in Tocqueville’s model, which combines the ancient cyclical science of regime change with modern theories of revolutionary progress. What Tocqueville offers is a powerful political theory with considerable predictive power. Tocqueville, I consequently claim, should be viewed as a theorist of revolution rather than as a theorist of democracy per se.  相似文献

The relationship between the free press and democracy is at the core of much modern political theory. With the advent of digital media and the decline of newspapers, there is a need to reexamine this relationship. Tocqueville was an astute observer of the importance of newspapers to democratic life and the drawbacks of the medium. This article examines the central features of Tocqueville's view of newspapers, the issues he saw with the tone of newspapers in Jacksonian America, and the value of newspapers. I argue that this analysis shows the importance of a free press to democratic life but that digital media often lacks the local element that Tocqueville saw as an essential feature of newspapers, and this deficiency is problematic for maintaining democratic liberty.  相似文献

ABSTRACT

This paper assesses to what extent the neo-Republican accounts of Quentin Skinner and Philip Pettit adequately capture the nature of political liberty at Rome by focusing on Cicero's analysis of the libera res publica. Cicero's analysis in De Republica suggests that the rule of law and a modest menu of individual citizens’ rights guard against citizens being controlled by a master's arbitrary will, thereby ensuring the status of non-domination that constitutes freedom according to the neo-Republican view. He also shows the difficulty of anchoring an argument for citizens’ full political participation in the value of non-domination. While Cicero believed such full participation (by elite citizens) was essential for a libera res publica, he, like other elite Romans, argued for participation on the basis of liberty conceived as the space to contend for and enhance one's social status. The sufficiency of the rule of law and citizens’ rights for securing a status of non-domination taken together with their insufficiency for ensuring a libera res publica suggests that neo-Republican accounts of liberty do not fully capture the idea as articulated in Cicero's Republicanism.  相似文献
