试论在美国的中国公民权益受侵犯及其保护

针对目前在美国的中国公民权益受侵犯案件时常发生的现状,结合对从美国回来的华侨进行的社会调查,从国际法的视角,分析了在美国的中国公民权益受侵犯的主要现象和原因;指出了侵犯在当地的中国公民权益,是对国际法上关于国际人权保护和反种族歧视原则的践踏;并就如何保护在美国的中国公民权益问题提出了自己的看法。

The Violation of Rights and Interests of Chinese Citizens in the United States;Observation and Recommendations

A huge number of Chinese have either visited the United States or become permanent residents of the country over the past three decades,and all of them can be categorized as Chinese citizens so long as they retain their Chinese nationality.Frequently the legal rights of Chinese citizens in the U.S.would be violated by the local authorities.Based on the interviews conducted among Overseas Chinese returned from the U.S.,the author lists a number of facts to show how and why the rights and interests of Chinese citizens have been violated,together with an analysis from the perspective of international law.The author contends that the violation committed by the American government is an infringement of international treaties and proclamations on human rights protection and anti-ethnic discriminations,which is not acceptable.In addition,the author proposes a number of policy recommendations on how to safeguard the legitimate rights and interests of Chinese citizens in America.
