Taking the Local: The Reagan Administration, New Federalism, and Fair Housing Implementation

Affiliation:Charles M. Lamb (Ph.D., Alabama) is an associate professor of political science at the State University of New York at Buffalo where he teaches courses in public law and public policy. He has co-edited four volumes, including Implementution of Civile Rights Politics (1984) with Charles S.Bullock, III. Currenty, he is working on a book on federal fair housing policy from the New Deal through the Clinton administration.;Jim Twombly (Ph.D., State University of New York at Stony Brook) is an assistanc professor of political science, State University of New York at Buffalo. His major publications include "Street-level Political Controls Over Federal Bureaucracy" (Americn Political Science Review, 1991) with John T. Scholzand Barbara Headrick. Current research interests include determinants of bureaucmtic behavior, with emphasis on OSHA and HUD regulation as symbolic politics;and the voting behavior of political parties in Congress.
Abstract:This article explores how "New Federalism" under President Ronald W. Reagan manifested itself in the implementation of fair housing policy. We examine the Fair Housing Assistance Program (FHAP) and how it led to state and local civil rights agencies playing an increasingly vital role in implementing the Fair Housing Act of 1968. Relying on data provided by the U.S. Department of Housing and Urban Development (HUD), we show that a significant number of fair housing complaints were shifted from HUD to state and local agencies.
