Current theoretical understanding of compliance with international law is based on an assumption that international law consists of a finite set of objective, compulsory rules. This image does not match reality but the two can be reconciled through theorising international law as ideology. Such an approach subsumes questions as to why states do or do not obey law and what influence international law has on foreign policy decision making. By placing the relationship of state behaviour to international law in a broader perspective it can account for previously identified determinants of compliance and provide a basis on which to assess their relative significance. At the same time, the research agenda regarding compliance is broadened by the introduction of fresh questions.  相似文献

On May 31, 2010, Australia instituted proceedings before the International Court of Justice in the case of Whaling in the Antarctic (Australia v. Japan). Although Australian politicians had for some time threatened such a course of action, the decision to proceed with international litigation took many observers by surprise, most basically because Japan appeared to be in a strong legal position and the risks associated with the case appeared greater than Australia's prospects for success. This article examines the background to the whaling dispute and suggests two ways in which litigation in the World Court may contribute to resolution of the dispute no matter the legal outcome of the case.  相似文献

English School approaches to international politics, which focus on the idea of an international society of states bound together by shared rules and norms, have not paid significant explicit attention to the study of security in international relations. This is curious given the centrality of security to the study of world politics and the recent resurgence of English School scholarship in general. This article attempts to redress this gap by locating and explicating an English School discourse of security. We argue here that there is indeed an English School discourse of security, although an important internal distinction exists here between pluralist and solidarist accounts, which focus on questions of order and justice in international society respectively. In making this argument, we also seek to explore the extent to which emerging solidarist accounts of security serve to redress the insecurity of security in international relations: the tendency of traditional security praxes to privilege the state in ways that renders individuals insecure.  相似文献

This paper examines regional, ethnic-specific patterns and individual-level correlates in same ethnic marriages (endogamy) and ethnic intermarriages in Indonesia. With data from over 47 million couples in prevailing marriages from the full enumeration of the 2010 Census, we outline the provincial variations in endogamy against development indicators and an ethnic fractionalisation index. We compare the prevalence of endogamy for major ethnic groups, and use network plots to examine pairing patterns in ethnic intermarriage. We use multivariate analysis to summarise the relationships between the likelihood of endogamy and migration status, ethnic group size, age group, and education for individuals in two selected provinces: North Sumatra and Jakarta. There is evidence to support negative associations between endogamy rates and provincial development indicators. Endogamy rates vary across major ethnic groups, and as expected, are higher in relatively large ethnic groups. In Jakarta and North Sumatra, individuals in urban areas, with younger age, and higher level of education have lower likelihood of endogamy. We found a positive relationship between ethnic size and endogamy, but conflicting results on the association between lifetime migration and endogamy in both provinces. By studying ethnic pairing patterns, this research provides a unique window to understand the dynamics of development, social change, and social stratification in an ethnically diverse emerging democracy.  相似文献

The introduction of Western science in order to change physical and operational aspects of Shanghai’s Huangpu River had been debated by Qing and Western officials since almost the beginning of its history as a Treaty Port. At stake in those debates was the perception of the river’s proper use: as a natural barrier for military defense, or as a conduit for global trade. After the Western powers unified to militarily suppress the Boxer Uprising in 1900, they attained their long-awaited goal of the right to transform the river for global trade as part of Article 11 of the Boxer Protocol: the Junpuju (or Huangpu Conservancy Board) was created and authorized by the central government to make the Huangpu River navigable for shipping vessels. Although the Junpuju continued the ethos of earlier extra-bureaucratic organizations established during the Self-Strengthening Movement, after 1901 the organization bore the authority of the central government. During the era of the New Policies, Qing officials were intent on revising the original terms of river conservancy so that they would be more favorable to Chinese sovereignty. At the same time, imperialist rivalries among the Western powers ruptured the apparent unity of the earlier alliance during the suppression of the Boxer Uprising. Before long, Western corruption in the Huangpu River dredging was brought to the attention of Qing officials, who deftly used it to recover Qing control over certain parts of the body of the river.  相似文献

In recent years, Head Start's prominent role in preparing low‐income 4‐year‐olds for school has been affected by rapid growth in state‐funded pre‐K programs, some of which are based in public schools. This has led to questions about the comparative advantages of these two approaches to early education. An analysis of data from Tulsa, Oklahoma, indicates that the school‐based pre‐K program is more effective in improving early literacy outcomes, while Head Start is more effective in improving health outcomes. The two programs are comparable with regard to early math learning. Social–emotional effects are more subtle, but the school‐based pre‐K program has demonstrable positive effects, while the Head Start program does not.  相似文献

In the lead-up to the Australian federal election in 2010, both major political parties represented the ‘unauthorised’ arrival of asylum-seekers as a security issue. This article explores the dynamics of this resecuritization of asylum in Australia, suggesting the case has important implications for both the securitization framework and Australia's treatment of asylum-seekers. The relationship between securitization and calls for an open debate about asylum-seekers challenges the securitization framework's normative claims about political debate and deliberation as a progressive development illustrative of desecuritization (the removal of issues from the security agenda). This case also illustrates that without political leadership to engage with the social and cultural context that allows the securitization of asylum to resonate with large segments of the Australian population, the exploitation of this issue for short-term political gain will continue.  相似文献
